Any business that violates any of the provisions of this division shall be deemed guilty of violating an ordinance governing public health and sanitation, which is a misdemeanor, and upon conviction thereof in the municipal court of the city shall be punished by a fine up to the maximum of $2,000.00.

Downtown businesses shall have two garbage pickups per week. Regular trash is collected each Tuesday and Friday afternoon. All garbage must be placed at curbside no later than 1:00 p.m. and not placed out any earlier than 11:00 a.m. Each business is limited to four regular-sized bags per pickup. Garbage is to be placed in black bags.

Businesses without alleyway access shall place no more than four regular-sized bags per business at the curb or alleyway (see section 13.02.159 for business provisions regarding utilizing recycling/garbage with multiple tenants).

Where carts are used, they shall be placed at the curbside by 7:00 a.m. on collection day and removed immediately after collection.

A work order with the city’s solid waste services department should be placed for the collection of large items. Contact the solid waste services department prior to placing these items at the curbside or alleyway.

Downtown businesses using the cart and bag service will be charged a flat rate as set forth in the fee schedule on their utility bill. Businesses using the dumpster service are required to purchase a dumpster and pay a monthly collection fee. (See section 13.02.041 for a listing of these fees.)

Multi-unit tenants shall be charged on a per-unit basis. Each tenant shall be charged a flat rate as provided in the fee schedule and allowed up to four regular-sized bags per pickup per week.

Under no circumstances shall downtown merchants place household garbage at curbside, in carts, or in dumpsters serviced by the city’s solid waste services department. This provision also applies to litter containers provided for pedestrian traffic. Violations of these provisions will be subject to a penalty under section 13.02.151.
