The city lake and the adjacent grounds are open to public use for fishing and picnic uses.

(a) 
The city lake is open to public use for fishing and picnic or day uses not prohibited by this ordinance uses [sic], upon issuance of an appropriate use permit as set forth in this division.
(b) 
Permits are required for use of the city lake. Permits are obtainable from the city by payment of a permit fee in the amount established by city council. The purpose of the permit fee shall be to defray the costs of maintaining records of the public use of the city lake and to support the maintenance of the city lake and the adjacent grounds.
(c) 
Permits are issued by the payment of a fee and the completion of an application which shall be made available at city hall and shall be in a form as determined by the city administrator or his or her designee. The issued permit shall specify whether it is an individual permit, or if a family permit is issued, the permit shall specify the number of family members the permit is issued for. The permits available for fees for issuance are as follows:
(1) 
An individual or family annual permit fee which shall last for one (1) year from the date of issuance; and
(2) 
An individual or family day use permit fee which shall last for twenty-four (24) hours from the date and time of issuance.

Fishing on the city park lake is permissible with a current state parks and wildlife fishing license and a city use permit. No trot-line fishing, use of nets, or traps of any kind are permitted.

The city lake shall be open for fishing use twenty-four hours per day with a permit as required by this division. All other uses shall be limited to the hours between sunrise and sunset with a use permit.

(a) 
The following uses and activities are prohibited on the city lake or the grounds adjacent to the city lake:
(1) 
Possession and consumption of alcohol.
No alcohol is allowed or permitted upon the city lake or upon the grounds adjacent to the city lake;
(2) 
Overnight camping.
No overnight camping is permitted;
(3) 
Campfires.
No fires of any kind for any purpose are permitted upon the city lake grounds;
(4) 
ATVs or other off-road equipment or vehicles.
No all-terrain vehicles, utility vehicles, or other off-road equipment is permitted to be operated upon the city lake grounds. No motor vehicles may be operated upon the grounds adjacent to the city lake in any manner that damages in any way any landscaping, roadways, trails, or any other portion of the property or grounds adjacent to the city lake;
(5) 
Boats.
No self-propelled watercraft utilizing motors in excess of ten (1) [sic] horsepower are permitted upon the city lake which shall include and apply to motorized boats, kayaks, canoes, jet-skis, or any other motorized or self-propelled vehicles;
(6) 
Glass bottles or containers.
Glass bottles and glass containers are prohibited;
(7) 
Unrestrained dogs.
No unrestrained dogs are permitted; all dogs must be restrained by a leash and under the direct control of an adult;
(8) 
Firearms and weapons prohibited.
No firearms, air guns, paint-ball guns, or archery equipment is permitted upon the city lake; no hunting is allowed;
(9) 
Swimming and wade fishing.
Swimming and wade fishing is not permitted; and
(10) 
Littering or dumping.
Littering or dumping is prohibited; any trash, garbage, or any other property left behind or not collected by a user shall constitute the prohibited act of littering.
(b) 
Violations.
Any activities or uses not permitted under this section shall constitute a violation of this division.
(c) 
Signage.
The city may place signage outlining rules and regulations. Damaging, defacing, removing, or destroying any city-installed sign shall constitute a violation of this division.

The provisions of this division shall be enforced by those persons or agencies designated by municipal authority. The chief of police, and his or her designee, are at all times granted authority to enforce this division.

Any person who shall violate any of the provisions of this division, or shall fail to comply therewith, or with any of the requirements thereof, within the city limits shall be deemed guilty of a misdemeanor and shall be liable for a fine not to exceed a sum in accordance with the general penalty provided in section 1.01.009 of this code. Each violation shall constitute a separate offense. Such penalty shall be in addition to all the other remedies provided herein.
