(a)
The water utility of the city, being such municipal utility as provides water and wastewater services to the citizens of the city, shall pay a franchise fee to the city’s general fund to compensate the general government of the city for access to its rights-of-way, deterioration of its public infrastructure, and interruption of its rights-of-way for the purposes of maintaining and operating said utility.
(b)
The amount of payment of such franchise fee shall be equal to 5% of the utility’s gross receipts for water, sewer, and garbage service, including penalties, late fees, connection and transfer fees, etc.
(c)
The remittance of this franchise payment shall be made in a minimum of four annual payments.
(d)
The payment of the franchise fee shall be effective for the period of time beginning October 1, 2006, and continuing thereafter.
