A. 
Purpose. The purpose of this Section is to regulate privately owned property, dwelling unit, or portion thereof used as short-term rental units and minimize any potential negative effects of said units on surrounding residential neighborhoods.
B. 
Procedure. A short-term rental permit is an annual administrative process outlined herein. A short-term rental permit shall not be issued or renewed unless the application meets all requirements established in this Article.
C. 
Applicability Of Permit.
1. 
A short-term rental permit is a permit issued to the individual applying for the rental permit. As such, said permit shall not run with property, but shall be personal unto the applicant. Applicants shall not have the right to assign, transfer, barter or sell said short-term rental permit and said permit shall terminate upon any transfer of the property by the applicant including by sale or lease.
2. 
Within thirty (30) days of a change of property ownership, change of operator, or any other change in material facts pertaining to the information contained in the short-term rental permit, the operator shall submit an application and requisite application fee for a new short-term rental permit if continued use is desired.
D. 
Period Of Validity.
1. 
No short-term rental permit shall be approved for a period longer than one (1) year from the date of issuance for the short-term rental permit.
2. 
A short-term rental permit must be renewed annually by the applicant to remain valid. Failure to renew a short-term rental permit within thirty (30) calendar days of expiration will result said permit being terminated.
3. 
The City of Maryville may terminate any short-term rental permit for failure to perform according to the standards and conditions outlined in this Article.

A. 
All applications for a short-term rental permit shall be made by written application to the Administrative Assistant to Public Works, on forms provided. Unless the application shall conform in all respects to the requirements of this Chapter, it shall not be accepted for consideration.
B. 
Information Required. An application for a short-term rental permit shall contain the following information:
1. 
The name, address, valid email address, and telephone number of the owner of the subject short-term rental unit.
2. 
The name, address, valid email address, and telephone number of the operator of the subject short-term rental unit.
3. 
The physical address of the proposed short-term rental unit.
4. 
The number of bedrooms and the applicable overnight and daytime occupancy limits of the proposed short-term rental.
5. 
Current zoning classification and use of the subject property.
6. 
Any additional information as City staff deems reasonably necessary to administer the intent of this Article.
C. 
Application Fee. The application shall be accompanied by a filing fee for the short-term rental permit.
1. 
Application fee for the short-term rental permit shall be one hundred twenty-five dollars ($125.00).
D. 
Time Of Application. The Administrative Assistant to Public Works, shall note the date of the filing of the application on the permit.

A. 
Short-term rentals shall comply with the following standards:
1. 
Meets all requirements as established by this Article VIII.
2. 
Is proposed to be operated so that public health, safety, and welfare of citizens will be protected.
3. 
A short-term rental shall comply with all zoning and site regulations of the property as outlined in Chapter 405.
4. 
A short-term rental permit shall not be issued or renewed if there are unresolved City Code issues, outstanding fines or fees, liens, or applicable taxes.
B. 
The City may conduct an inspection of the short-term rental unit prior to issuing a new permit and prior to issuing any renewal permit which shall be subject to Fire Code and Building Code inspection requirements.
C. 
A short-term rental permit application may be denied if the applicant has had a prior short-term rental permit suspended or revoked for any reason.

A. 
The property shall not be rented or solely used for outdoor receptions, parties, weddings, or similar activities.
B. 
Operational requirements of a short-term rental are as follows:
1. 
While a short-term rental is rented, the owner or operator shall be available twenty-four (24) hours a day, seven (7) days a week for the purpose of responding within thirty (30) minutes to complaints regarding the condition, operation, or conduct of occupants or guests of the short-term rental. Failure of the operator to respond to calls or complaints regarding the condition, operation, or conduct of occupants and/or guests of the short-term rental unit within thirty (30) minutes and in an appropriate manner shall render the operator subject to all remedies including revocation of the short-term rental permit.
2. 
All short-term rental operations will maintain strict adherence to all Municipal Code of Maryville regulations throughout the term of a rental period, including but not limited to the following:
a. 
Building and Housing Codes.
b. 
Nuisance Regulations.
3. 
Maximum Number Of Occupants. The maximum number of overnight guests and residents for a short-term rental unit shall not exceed two (2) persons per bedroom for a maximum of ten (10) overnight guests.
4. 
All exterior improvements or modifications to the short-term rental property shall adhere to any applicable Design Guidelines adopted by the City of Maryville.
5. 
Bed and breakfast facilities are permitted exterior identification signage not to exceed nine (9) square feet, mounted on the surface of the primary structure.
6. 
No short-term rental or subsequent use of the property shall cross over any property line.
7. 
All parking associated with the short-term rental unit shall be located entirely on-site, in a garage, carport, or any legal public parking areas.
8. 
The City shall have the authority to impose additional conditions for short-term rental units to ensure any potential secondary or negative effects unique to the property are avoided or adequately mitigated.
