A. 
It is hereby found and declared that the present and future solid waste disposal inherent problem within the Village of Speculator, unless addressed, will be detrimental to the public health, comfort, convenience, safety, and general welfare of the inhabitants of the Village of Speculator, and the provisions and prohibitions hereinafter contained are enacted in the public interest and are for the purpose of securing and promoting the public health, comfort, convenience, safety, and welfare of the Village of Speculator and its inhabitants.
B. 
This article is intended and purposed to protect the air, ground-, and surface water, for the reuse of products heretofore known as "throwaway" products, the conservation of such natural resources as wood, petroleum and mined minerals, and the reduction of loss of valuable land now being devoted to burial of solid waste.
As used in this article, the following terms shall have the following meanings:
COMMERCIAL AND INDUSTRIAL GARBAGE
All nonhazardous and nontoxic wastes which are not commercial and industrial by-products.
CONSTRUCTION AND DEMOLITION DEBRIS
Waste material resulting from construction, remodeling, repair, and demolition of structures, roads, buildings, and land clearing. Such material shall include but not be limited to bricks, concrete and other masonry materials, soil, lumber, road spoils, paving materials, and brush.
GREEN WASTE
Grass clippings, leaves, and cuttings from shrubs, hedges and trees.
HOUSEHOLD GARBAGE
Putrescible solid waste, including animal and vegetable waste, resulting from the handling storage, sale, preparation, cooking or serving of foods, garbage originating primarily from home kitchens, stores, markets, restaurants, and other places where food is stored, prepared, or served.
HOUSEHOLD HAZARDOUS WASTE
Includes but is not limited to the following products and their empty containers: hair spray, pesticides, insecticides, herbicides, petroleum products, caustic chemicals, paint, batteries, and including automobile batteries.
LARGE HOUSEHOLD FURNISHINGS
All other large and/or bulky articles used in the home and which equip it for living, including but not limited to chairs, sofas, tables, beds, carpets, etc.
MAJOR APPLIANCES
A large and/or bulky household mechanism including but not limited to stoves, refrigerators, washing machines, dryers, and freezers, ordinarily operated by gas, wood, or electrical current.
MOTOR VEHICLES
Motor vehicles as defined in the Vehicle and Traffic Law of the State of New York.
NONRECYCLABLE MATERIAL
Soft plastic containers, rags, sweepings, excelsior, rubber, leather, crockery, straw, dirt, filth, ashes, wastepapers and similar waste material.
PERSON
The term "person" as used in this article shall include an individual, society, club, firm, partnership, corporation or association of persons, and the singular number shall include the plural number.
RECYCLABLE MATERIAL
Material separated from the waste stream for its reuse or resale value, said material being all cardboard, newspapers, magazines, and flat paper. Said material also shall include commercial packaging or processing including all cans, glass, food containers, bottles with metal rings and tops removed, and hard plastics.

SOURCE SEPARATION
The separation of recyclable materials at the point of generation for separate collection.
VEHICULAR TIRES
Tires from cars, trucks, and other vehicles and their casings.
No person shall dispose of household garbage or recyclable or nonrecyclable material except as follows:
A. 
In order to facilitate the conservation of vital natural resources through recycling, each person shall separate the waste into the following three categories: garbage, recyclable materials, and nonrecyclable materials, and each person shall provide separate suitable, and sanitary containers as authorized by the Board of Trustees of the Village of Speculator for each of the three categories of waste.
(1) 
Each market, store and restaurant shall provide suitable dumpsters to contain household garbage and shall provide electric security or other suitable apparatus that will secure the entrance to refuse containers or dumpsters to prevent animals from having access to the garbage or have secured, suitable covered containers not to exceed 30 gallons.
(2) 
Each residence shall dispose of household garbage in covered containers not to exceed 30 gallons.
B. 
In order to facilitate the conservation of vital natural resources through recycling, discarded newspapers and cardboard shall be separated from other recyclable material for separate disposal, and said newspaper and cardboard shall be securely tied in bundles each weighing not in excess of 40 pounds.
C. 
From the time of placement of garbage, recyclable material, and nonrecyclable material at the curb or at a recycling site by a person for collection in accordance herewith, such garbage, recyclable material and nonrecyclable material shall become the property of the Village of Speculator or its authorized agent until it is disposed of at an authorized landfill, transfer station, or recycling center. It shall be a violation of this article for any person, without the authority of the Village Board of Trustees, to collect, pick up, remove, or cause to be collected, picked up or removed any garbage, recyclable material or nonrecyclable material at any of the foregoing locations, and each such collection, pickup, or removal from one or more of said locations shall constitute a separate and distinct offense in violation of this article.
D. 
It shall be a violation of this article for any person to place at the curb any container other than a container which solely contains garbage or solely contains recyclable material or solely contains nonrecyclable material.
E. 
It shall be a violation of this article for any person to knowingly dispose of any hazardous household or industrial waste by including same in garbage or nonrecyclable materials.
A. 
All motor vehicles which are to be discarded from a residence shall at the cost and expense of the owner be removed to a place designated for such motor vehicles at the Hamilton County Transfer Station in compliance with the agreement with Hamilton County. All fluids shall be drained from said vehicles, and all objects which are not integral parts of the vehicle to be discarded shall be removed from said vehicles, before removal to said transfer station. A fee shall be paid equal to the fee as prescribed by said County of Hamilton.
B. 
No person shall place or store construction debris with garbage, recyclable material or nonrecyclable materials. The Village of Speculator shall not collect construction or demolition debris. The person generating or producing construction or demolition debris or the owner thereof may at his own cost and expense have such material moved to the designated area in the County of Hamilton transfer station in accordance with county regulations which provide that such material does not include asphalt, roofing, or shingle material.
C. 
All major appliances or large household furnishings which are to be discarded from a residence of the Village of Speculator where the appliance or furnishing was actually in use shall at the owners cost and expense be removed to a place designated for such materials in the Hamilton County transfer station in accordance with county regulations. It shall be the sole responsibility of the owner to dismantle the appliance or furnishings so that it will not be a hazard to the public. In this respect, doors shall be removed from the appliances or furnishings before placing at the transfer station. The Village of Speculator on certain specified days will also pick up said appliances at the side of the street in residential areas.
No person shall place or store green waste with garbage, recyclable material, or nonrecyclable materials. The person generating or producing green waste may at his own cost and expense remove same to a designated area at the Town of Lake Pleasant site provided for the disposal of same in accordance with Town of Lake Pleasant regulations for said site.

Any person, firm or corporation who shall violate any of the provisions of this article or any rule or regulation made pursuant thereto shall, upon conviction thereof, be punished by a fine of not more than $250 or imprisonment for not more than 15 days, or both; each section of this article that is violated and each day on which such violation continues shall constitute a separate offense.
It is the intention of the Board of Trustees that each separate provision of this article shall be deemed independent of all other provisions herein, and it is the further intention of the Board of Trustees that if any provision of this article be declared to be invalid, all other provisions thereof shall remain valid and enforceable.
