The purpose of this article is to provide for the proper drainage of rainwaters, floodwaters, and other water conditions that exist at the property being developed or altered so as to affect other properties and drainage within the area.

(a) 
The owner, lessor or user of any property shall obtain approval from the town engineer prior to the construction of any of the following facilities that may in any manner be used for the carrying of rainwaters, floodwaters or excess water from the property or in and around and across the drainage ways serving the properties:
(1) 
Any culvert or piping constructed to carry the flow of water.
(2) 
Any crossing or bridging of a drainage way to include a drainage ditch, alley, street right-of-way, driveway or portion of the property that is necessary for the free flow of water.
(3) 
Any inlet or outlet that would affect the direction or amount of flow of water, either across or from this property to adjoining or adjacent areas.
(b) 
Any and all fees necessary to properly engineer the installation shall be paid by the individual or entity prior to any installation.

It shall be the duty and obligation of all owners, occupants, and users of real property within a subdivision abutting drainage facilities in the town, at their own cost and expense, to maintain and keep such drainage facility adjoining their property free from accumulations of unsanitary, unsightly conditions and tall grass and weeds. Where and when, by reason of a violation of this section, injury or damage is occasioned or inflicted on any person, primary liability for all such injury or damage shall rest upon the owner, occupant, or user of the property abutting on and served by such drainage facility.

Any owner, user, lessor or person aggrieved by any finding of the town engineer which involves a decision as to the installation as herein set out may appeal to the town council within thirty (30) days from the date of such finding or action and not thereafter.
