The Village is not responsible for providing drainage facilities on private property for the management of stormwater on that property. The property owner shall be responsible to provide for, and maintain, private stormwater runoff facilities in compliance with Chapter
313, Stormwater: Illicit Discharge and Connection, serving the property and to prevent or correct the accumulation of debris that interferes with the drainage function of a water body.
All stormwater management facilities shall be constructed and
maintained in accordance with applicable federal, state, and local
laws, ordinances, rules and regulations, and they shall not conflict
with any existing local stormwater management, wetlands and watershed
plans.
The Village shall utilize the performance and design standards adopted pursuant to Article
X of this chapter for stormwater discharge and release rates. However, if the Village Planning Commission makes a specific finding that these standards are not appropriate for a specific site and cannot be followed, the Village is authorized to establish minimum design standards for stormwater discharge release rates and to require dischargers to implement on-site retention, detention or other methods necessary to control the rate and volume of surface water runoff discharged into the stormwater drainage system if the circumstances outlined in Article
X of this chapter apply.
