This chapter is adopted pursuant to the authority granted to municipalities by Chapter 22, Title 15.2, Code of Virginia, to regulate and assure the orderly subdivision of land and its development within the Town.

For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:
BUILDING SETBACK
The minimum distance that a building must be set back from the front and side lot lines or front and side boundary lines.
LOT
A portion of the subdivision intended for transfer of ownership or for building development for a single building and its accessory buildings.
PLAT
Includes the words map, plan, plot, replat and replot.
SUBDIVISION
A division of a lot, tract or parcel of land into two or more lots or other subdivisions of land, for the purpose, whether immediate or future, of transfer of ownership or of building development, including all changes in street or lot lines.
Where a subdivider can show that a provision of this chapter would cause an unnecessary hardship if strictly adhered to and where, because of topographical or other conditions peculiar to the site, in the opinion of the Town Council, a departure may be made without destroying the intent of such provision, the Town Council may recommend a variance. Any variance thus authorized is required to be entered in writing in the minutes of the Council and the reason on which the departure was justified set forth.
The regulations and restrictions established in this chapter may, from time to time, be amended, supplemented, changed or modified or repealed by a majority of votes of the Council, provided that:
A. 
A public hearing shall be held in relation thereto at which parties in interest and citizens shall have an opportunity to be heard.
B. 
Notice shall be given of the time and place of such a hearing by publication in at least two weekly issues of some newspaper having a general circulation in the Town. Such notice shall specify the time and place of the hearing at which persons affected may appear and present their views, not less than five days nor more than 21 days after final publication.

Any owner or proprietor of any tract of land who subdivides that tract of land and who violates any of the provisions of this chapter shall be punishable as a Class 2 misdemeanor, and each day after the first during which the violation shall continue shall constitute a separate violation.
