(a) The
building official, or assignee, of the city is hereby authorized to
perform inspections of any place of public accommodation in the city
(including but not limited to, hotels, motels, bed and breakfasts)
for compliance with state law and/or any local regulations related
to sanitation and safety.
(b) Said
inspections may be performed:
(1) On
an annual basis at the discretion of the building official; or
(2) At
any reasonable time upon complaint by any guest or tenant .

Complaints may be filed in the office of the city secretary.
The complainant should have the name, address and room number of the
hotel/motel available when filing the complaint.

(a) Upon
receipt of a complaint as outlined herein, the building official will
investigate said complaint and whether or not a violation is found,
shall perform an exit review with the owner, manager or person in
charge of the premises at the end of the inspection, which includes
reviewing each violation found by the inspector, and having the owner,
manager or person in charge of the premises sign the inspection sheet,
retaining a copy. The signature will act only as an acknowledgement
of the findings of the inspection and will not be taken as an admission
of violation or guilt. The signature will also act as agreement/acknowledgement
that the exit review was performed and they are aware of any violations
occurring on this visit.
(b) Upon
receipt of a complaint as outlined herein, the building official will
investigate said complaint and if a violation is found, shall notify
the owner of the place of public accommodation by mail, return receipt
requested, of the violation(s).

(a) Upon
receipt of notice as outlined herein, the owner shall have thirty
(30) days to abate the condition(s) constituting a violation. The
building official will investigate the conditions at the end of said
thirty-day period to determine compliance.
(b) Any
person who shall willfully refuse or fail to abate conditions under
the terms of this article, and/or any person who shall interfere with
or hinder said abatement under the terms of this article, shall be
deemed guilty of a misdemeanor and punished as set forth in section
1.109 of this code of ordinances. In case the owner or occupant of
any such establishment shall be a corporation, and shall violate any
provision of this article, the president, vice-president, secretary,
treasurer of such corporation, or any manager, agent or employee of
such corporation shall be also severally liable for the penalties
therein provided.

This article in no way restricts or otherwise limits enforcement authority with regard to other ordinances of the city. In particular, chapter
3, article
3.300 of this code of ordinances regarding substandard buildings shall apply when justified.
