The city commission hereby finds and declares it a nuisance for any person to possess with the intent to distribute, by sale or otherwise, any squib, firecracker, grenade, gun, cartridge, firearm, or other combustible materials without a permit, or to cast, throw or fire any squib, rocket, cracker, grenade, gun, revolver, pistol, shotgun, rifle, firearm, cartridge, or other combustible fireworks of any kind within the corporate boundaries of the city, or in that area of the city’s extraterritorial jurisdiction within 5,000 feet from any point of the city’s corporate boundaries.

It will be a violation for a person, firm, corporation or association to:
(1) 
Cast, throw or fire a squib, firecracker, grenade, gun, cartridge, firearm, or other combustible materials without a permit, or to cast, throw or fire any squib, rocket, cracker, grenade, gun, revolver, pistol, shotgun, rifle, firearm, cartridge, or other combustible fireworks of any kind within the corporate boundaries of the city, or in that area of the city’s extraterritorial jurisdiction within 5000 feet from any point of the city’s corporate boundaries; or
(2) 
Exhibit or have in its possession, with intent to give away or sell or offer for sale within the city, any squib, rocket, firecracker, grenade, cap or cartridge, or other combustible fireworks of any kind, within the corporate boundaries of city or in the area of the city’s extraterritorial jurisdiction within 5000 feet from any point of the city’s corporate boundaries.

The police department is assigned the responsibility of enforcing this regulation. Enforcement shall require a written warning given to any person who is the owner, is employed by, or is an agent of the owner of the firecrackers or fireworks who is offering these for sale. Notice to the employee or agent shall constitute notice to the owner. Unless the distribution or selling by the owner or the agent(s) or employee(s) of the owner has ceased within no more than four hours from the time of the warning, a citation shall be issued to the person or persons for violation of the regulation. Thereafter, each additional hour that the sales or distributions continue shall constitute a separate violation.

(a) 
It shall be a rebuttable presumption that an employer/principal has knowledge and approves of or ratifies his employee’s or agent’s conduct.
(b) 
A violation by an employee or agent and [of] another shall constitute a violation by the employer/principal as well.
