(A.) 
APPOINTMENT:
The City Commission by affirmative vote of a majority of all its members, shall appoint a City Manager in accordance with law, the Charter, and, specifically, Section 4.11 (A.) and (E.). There shall not be a contract, in any form, agreed upon which shall exceed one (1) year. If the City Commission desires not to renew the City Manager’s contract or remove him from office, it may do such only in accordance with Section 3.02 of this Charter.
(B.) 
QUALIFICATIONS AND COMPENSATION:
The City Manager shall be chosen by the City Commission solely on the basis of his executive and administrative training, education, experience, ability and his technical skills. He need not be a resident of the City or the State of Texas at the time of his appointment and, within three (3) years after accepting the position, he shall be residing within the City. No member of the City Commission shall, during the time for which he is elected, and for three years thereafter, be appointed City Manager. The City Commission shall determine the City Manager’s compensation in accordance with Section 4.11 (B.) and (E.).
The City Commission may remove the City Manager from office in accordance with the following procedure:

The City Commission shall adopt by affirmative vote of a majority of all of its members a preliminary resolution which must state the reasons for removal and may suspend the City Manager from duty for a period not to exceed forty-five (45) days. A copy of the resolution shall be delivered promptly to the City Manager.
2. 
Within eight (8) days after a copy of the resolution is delivered to the City Manager, he may file with the City Commission a written request for a public hearing. This hearing shall be at a City Commission meeting no earlier than twelve (12) days nor later than thirty (30) days after the request is filed. The City Manager may file with the City Commission a written reply not later than eight (8) days before the hearing.

The City Commission may adopt a final resolution of removal, which may be effective immediately, by affirmative vote of a majority of all its members at any time after eight (8) days from the date when a copy of the preliminary resolution was delivered to the City Manager, if he has not requested a public hearing, or at any time after the public hearing, if he has requested one. The City Manager shall continue to receive his salary until the effective date of a final resolution of removal. The action of the City Commission in suspending or removing the City Manager shall not be subject to review by any court or agency.
By letter filed with the City Secretary the City Manager shall designate, subject to approval of the City Commission, a qualified City administrative officer to exercise the powers and perform the duties of City Manager during his temporary absence or disability. During such absence or disability, the City Commission may revoke such designation at any time and appoint another officer of the City to serve until the City Manager shall return or is suspended or is removed or contract is not renewed, then the City Commission may appoint a temporary City Manager until a permanent one is appointed in accords with Section 3.01 of this Charter. During the temporary or permanent absence or disability of the City Manager, the City Commission as a whole may act as the City Manager. However, no individual member of the Commission may ever serve as City Manager.
The City Manager shall be the Chief administrative officer of the City. He shall be responsible to the City Commission for the administration of all City affairs placed in his charge by or under this Charter or by ordinance or resolution or by law. He shall have the following powers and duties:

He shall appoint and, when he deem it necessary for the good of the service, suspend or remove all or any City employees and appointive administrative officers or Department Directors provided for by or under this Charter, except as otherwise provided by law, this Charter or personnel rules adopted pursuant to this Charter. He may authorize any administrative officer or Department Director who is subject to his direction and supervision to exercise these powers with respect to subordinates in that officer’s department, office or agency. In addition, with the consent of the City Manager any administrative officer or Department Director who is subject to his direction and supervision shall exercise these powers with respect to subordinates in that officer’s or Director’s department, office or agency.
2. 
He shall direct and supervise the administration of all departments, offices and agencies of the City, except as otherwise provided by this Charter or governing laws.
3. 
He shall attend all City Commission meetings and shall have the right to take part in discussion but may not vote.
4. 
He shall see that all laws, provisions of this Charter and acts of the City Commission, subject to enforcement by him or by officers subject to his direction and supervision, are faithfully executed.
5. 
He shall prepare and submit the annual budget program to the City Commission.
6. 
He shall submit to the City Commission and make available [to the] public a complete report on the finances and administrative activities of the City as of the end of each fiscal year.
7. 
He shall make such other reports as the City Commission may require concerning the operations of City Departments, offices and agencies subject to his direction and supervision.
8. 
He shall keep the City Commission fully advised as to the financial condition and future needs of the City Commission concerning the affairs of the City as he deems desirable.
9. 
The City Manager shall keep a journal of the City’s financial records; or if the City Commission in accordance with section 4.01 and 4.02 designates an officer to keep the City’s financial records, this officer shall be under the supervision and direction of the City Manager. The City Manager may appoint with the consent of the City Commission the City Secretary to serve in this capacity.
10. 
He shall perform such other duties as are specified in this Charter or by law or may be required by the City Commission.
