(a)
Generally.
Whenever a street is not furnished with a curb and gutter connected to a storm sewer for drainage purposes, a drainage ditch shall be provided at the expense of the owner of the property that is contiguous to the street and in accordance with specifications approved by the town council. No person shall construct or maintain a driveway over a drainage ditch without furnishing a culvert or other means to provide drainage, in accordance with specifications approved by the town council.
(b)
Maintenance.
The owner and occupants of contiguous property shall keep such culverts and ditches free of any obstructions and shall keep any grass mowed to a height not to exceed ten (10) inches.
(c)
Obstruction.
No person shall dump any leaves, trash, soil or other material into any such ditch or culvert and no person shall obstruct any such ditch or culvert in any manner whatsoever.
(d)
Penalty.
Any person violating any of the provisions of this section shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined in accordance with the general penalty provision found in section 1.01.009 of this code, and each day such violation continues shall constitute a separate and distinct offense.
