The Public Works Construction Standards North Central Texas,
fifth edition (2017), promulgated by the North Central Texas Council
of Governments, a copy of which is on file in the office of the town
secretary, is hereby adopted as the construction standard code for
regulating infrastructure construction within the town including but
not limited to paving, utility construction, construction of roadways,
driveways, approaches, parking lots, storm drainage improvements,
wastewater collection, water main improvements and other such infrastructure
improvements.

Failure to comply with the standards of construction adopted
by this article for infrastructure construction shall be unlawful
and a violation of this article.

Any person, firm or corporation violating any of the provisions
of this article shall be deemed guilty of a misdemeanor and upon conviction
shall be punished by a penalty of fine in accordance with the general
penalty provision set forth in Section 1.109 of this code for each
offense, except, where a different penalty has been established by
state law, the penalty shall be that fixed by state law not to exceed
the amount as set forth in the general penalty provision in Section
1.109 of this code and for any offense which is a violation of any
provision of this article that governs fire safety, zoning, public
health and sanitation, or the dumping of refuse, the penalty shall
be a fine not to exceed the amount as set forth in the general penalty
provision in Section 1.109 of this code. Each and every day such offense
is continued shall constitute a new and separate offense.
