The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Smoking or to Smoke.
The possession of a burning tobacco, weed or other plant product.

(a) 
A person commits an offense if he/she smokes inside the town hall facility at 320 Waketon Road.
(b) 
It is an affirmative defense to prosecution under this section if the person was smoking in a location that was does not have displayed or which was not posted as a no-smoking area with appropriate signs that, in substance, state: “No Smoking, Town of Double Oak Ordinance No. 03-004.”
(c) 
The town shall provide receptacles for the extinguishment of smoking materials within 20 feet of any public entrance to town hall.

Any person violating or failing to comply with any provision or requirement of this article shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished in accordance with the general penalty provision found in Section 1.109 of this code.
