(a) It shall
be unlawful for any person or persons to operate, drive or use a commercial
motor vehicle, truck-tractor, road tractor, trailer, semi-trailer,
pole trailer, or any combination thereof, through the confines of
the city limits of Double Oak, Texas, without specific business and
intent conducting the following within the confines of the city limits
of the Town of Double Oak, Texas, to-wit:
(1) stopping
and discharging, or stopping and picking up, passengers or goods;
(2) performance
of a business related service.
(b) It shall
be unlawful for a person or persons to operate, drive or use, a motor
vehicle [which is enumerated in (a) above] on the city streets of
Double Oak, Texas known as Cedar Crest Lane located between State
Highway 407 and Rancho Vista Drive without the specific business and
intent of conducting on Cedar Crest Lane, the matters specified in
(1) or (2) above.
(c) The provisions
of (1) and (2) above shall not apply:
(1) To
emergency vehicles operating in response to any emergency call;
(2) To
vehicles operated by a public utility while cruising in an assigned
area for the purpose of inspecting the facilities of said public utility
and/or providing maintenance service to said facilities;
(3) To
municipal vehicles performing Town of Double Oak business.
(d) Any person
violating any provision of this article shall be deemed guilty of
a misdemeanor and upon conviction shall be subject to a fine in accordance
with the general penalty provision set forth in Section 1.109 of this
code.
