(a)
Prohibited except on commercial zoned property.
It shall be unlawful for the owner of any property within the city to cause to be installed therein and thereon any underground storage tanks for the storage of gasoline and/or diesel fuel, and any underground storage tanks which may have been heretofore installed may not be used for such purpose; provided, however, this prohibition shall not be applicable to property which has heretofore been or may hereafter be zoned as commercial property by the city.
(b)
Deliveries to underground tanks.
It shall be unlawful for any person or firm or corporation to deliver gasoline and/or diesel fuel in bulk quantities to any property within the city except to such property which is zoned as commercial property and on which there have been installed underground storage facilities for the storage of such gasoline and/or diesel fuel.
(c)
Penalty.
Any person, firm or corporation who shall violate any of the provisions of this section, or fail to comply with any of the requirements hereof, shall be guilty of a misdemeanor and shall be liable to a fine of not more than two hundred dollars ($200.00), and each day such violation shall be permitted to exist shall constitute a separate offense.
