This article shall be known and may be cited as the utility development ordinance of the city.

(a)
It shall be unlawful for any person, firm, corporation, partnership, or association to erect, construct, repair, or maintain any utility facility, service line or installation in the city contrary to or in violation of any pertinent provisions of this article, or to cause, permit or suffer the same to be done.
(b)
Any person violating any provision of this article shall be deemed guilty of a misdemeanor. Each such person shall be deemed guilty of a separate offense for each and every day, or portion thereof, during which any violation of any provision of this article is committed, continued, or permitted. Upon the conviction of any such violation, such person shall be punishable by a fine of not more than two thousand dollars ($2,000.00) for each separate offense for each and every day or portion thereof (e.g., ten (10) days = a maximum of $20,000.00).
(c)
The issuance of a permit based upon plans and specifications shall not prevent the city from thereafter requiring the correction of errors in said plans and specifications, or from preventing building operations being carried on thereunder when in violation of this article or of any other ordinances of the city.
(d)
Prosecution or conviction under this provision shall never be a bar to any other remedy or relief for violation of this article.
