The area bordering New Haven Avenue, Wilcox Park and the Wepawaug River, which area includes, but is not limited to, the Fowler Building, Fowler Pavilion, Founders' Walk, Milford Public Library, Ralph Clarkson Field, Shawn Murray Field, John Francis Field, Peter Bernard Field, the boat ramp, tennis courts, playground, basketball courts, and all parking areas associated with the foregoing is deemed a public park and shall be known as "Fowler Park."

(a) 
It shall be unlawful and a violation of this chapter for any person to, within the boundaries of any public playground, park, beach or recreational areas within the City:
(1) 
Consume alcoholic beverages of any kind or to have an open alcoholic beverage container of any kind in his or her possession, except when the Park, Beach and Recreation Commission may, in its sole discretion, waive the provisions of this subsection by issuing a permit to the effect that any association, club, society or similar organization which applies in writing to the Commission for such permit, at least 15 days prior to the date for which the permit is sought.
(2) 
Consume, use or smoke any cannabis-type substances as defined in Connecticut General Statutes § 21a-240, or use tobacco products of any kind as defined in Section 10-23 of the Milford Code of Ordinances.
(3) 
Leave rubbish (that is, bottles, cans, paper, etc.) on or about the grounds of any playground, park, beach or any recreational area except in designated containers.
(4) 
Bring any animal into any athletic facility or play area. Bring any animal into any beach or park area, with the following exceptions:
a. 
Dogs on leashes not over 10 feet long will be permitted in Eisenhower Park except the model airplane field during operating hours, the gardens, soccer field, tennis court area and playing fields. The area where leashed dogs are permitted is as marked on the Eisenhower Park map on file at the City Clerk's office and is designated by signage at the park.
b. 
Dogs off leashes are permitted in the dog run at Eisenhower Park but must be brought to the run leashed and remain leashed at all other times.
(5) 
Expose for sale any goods or wares, solicit any contributions, or display any advertisement except upon special authority of the Park, Beach and Recreation Commission. The Park, Beach and Recreation Commission or its agent (Recreation Director) shall designate an approved location within each park and beach area where such permitted activity may be conducted. Such special authority shall be granted by issuance of a license to vend in the park and beach area which expires on December 31 of the current year. Applicants must possess and maintain a valid City vendor permit to obtain or continue to hold a permit to vend at park and beach areas. Such special authority shall be granted for a fee of $1,000 per season. Authorized signs must be removed in strict accordance with the authority granted.
(6) 
Motor vehicles in designated areas; permit for handicapped persons.
a. 
Operate a passenger motor vehicle or passenger and commercial motor vehicle or camper, as the same are defined in Section 14-1 of the Connecticut General Statutes, as amended from time to time, or a truck with a capacity of not more than one ton, except in designated areas approved by the Park, Beach and Recreation Commission, and in those areas at a rate of speed not exceeding five miles per hour.
b. 
The provisions of Section 16-2 shall not apply to any person who is blind or physically disabled as defined by Connecticut State Statutes and who is operating or who is an occupant in a three- or four-wheel motor vehicle which is specially designed and adapted for the use and transportation of handicapped persons. Said handicapped persons must receive a permit to be issued by the Park, Beach and Recreation Commission upon documentary proof that such person is blind or physically disabled and said vehicle is specially adapted to handicapped use. Said permit shall clearly identify the specially adapted vehicle and the identity of the handicapped individual. Said permit shall be affixed to the motor vehicle and be in clear view at all times.
(7) 
With the exception of those motor vehicles listed in Subsection a(6) of this section, operate any type of motor vehicle, as the term "motor vehicle" is defined in Section 14-1 of the Connecticut General Statutes, as amended from time to time, specifically including, but not limited to, motorcycles, minibikes, trail bikes, go-carts, dune buggies, and snowmobiles unless a pooling area for such vehicles is designated at the entrance to any area covered by the term of this section and then only from such entrance to such designated parking area.
(8) 
Wash, clean, paint or make repairs to any motor vehicle in any park, or contaminate the streams and ponds by placing oil, polish, bottles, cans or any other materials therein.
(9) 
Bathe anywhere, except on beaches designated for that purpose, and only when they are officially open, or to use tubes or other inflated aids to swim on any bathing beach or to use soaps and detergents of any kind while bathing in public swimming areas.
(10) 
Have organized music or public speaking in any park except in places provided for that purpose and then only by written permit from the Park, Beach and Recreation Commission for the purpose of providing proper scheduling.
(11) 
Hunting, carrying of firearms and discharge of firearms and fireworks are prohibited in municipal parks and on municipal beaches owned and maintained by the City of Milford.
(12) 
Erect any tent, or to camp or live in any park or beach without written permission of the Park, Beach and Recreation Commission.
(13) 
Use boats on any park waters, or waterways except upon special authority of the Park, Beach and Recreation Commission.
(14) 
Building fires and cooking food.
a. 
Light, kindle or use any fire in any of such parks, except in picnic areas, and then only in grills provided, unless by the permission of the Park, Beach and Recreation Commission.
b. 
No person shall build or attempt to build a fire or cook any food on any public beach within the City.
(15) 
Injure or disturb any bird, bird's nest, or eggs or any animal, wild or tame, within any of such parks.
(16) 
Cut, injure or deface, remove, or disturb any tree, shrub, building, fence, bench or other structure, apparatus or property; or pick, cut or remove any shrub, bush or flowers; or mark or write upon any building, fence, bench or other structure.
(17) 
Use abusive, profane or indecent language, or any conduct that may be offensive to the general public.
(18) 
Play baseball or other athletic activities except in areas set aside for these activities.
(19) 
Hold, conduct and/or address any public assemblage, meeting or gathering or to take part in any public debate or discussion, without having first obtained a written permit from the Park, Beach and Recreation Commission, for the purpose of providing proper scheduling.
(20) 
Ice skate in areas under the jurisdiction of the Park, Beach and Recreation Commission unless posted as safe for skating unless the Fire Chief deems the ice safe, at which time "No Skating" signs will be removed and "Skate at Your Own Risk" signs will be posted.
(21) 
Hours; violations and penalties.
a. 
Be in any portion of the park known as Eisenhower Park before sunrise or after sunset; or
b. 
Be in any public park or playground other than Eisenhower Park after 9:00 p.m. or be in any beach area or beach parking area before sunrise or after 9:00 p.m. November 1 through March 31 and after 10:00 p.m. April 1 through October 31 except:
1. 
By special written permission of the Park, Beach and Recreation Commission;
2. 
In reference to beach area and beach parking area, such permission will be granted only for fishing, jogging or strolling. Said request for permission shall disclose the names, ages, residences and mailing addresses of the persons requesting such permission. The request will cover the nature of the permission sought, i.e., fishing, jogging or strolling, and the period of time to be covered by said permission. The Commission may revoke said permission upon evidence of violation of the terms or conditions of this subsection;
3. 
The use of all public tennis courts, including the tennis courts at Eisenhower Park, until 10:30 p.m. is hereby permitted; and
4. 
Regulation of activity at the City dock and boat ramp is as set forth in Section 16-97[1] of the Code of Ordinances.

c. 
Penalty. Police officers may issue a citation for any violations of the provisions of this section. Persons receiving said citations shall be deemed to have committed an infraction and shall be fined $90 except using, smoking or consuming of any cannabis-type substance as defined in Connecticut General Statutes § 21a-240 shall be subject to a fine of not more than $50 for each offense.
(22) 
Dress or undress on any such beach or in any vehicle adjacent thereto.
