(a) The
city officials and employees are subject to litigation and liability
for actions taken in the proper discharge of official duties of their
office or employment with the city.
(b) The
city council wishes to shield officials and employees from the continual
concern over possible liability for money damages and the cost of
engaging legal council to defend actions undertaken in the course
of employment, where those actions and conduct do not violate clearly
established statutory or constitutional rights of which a reasonable
person would have known, and where their actions and conduct are in
the furtherance of a city policy.
(c) The
city hereby adopts the policies attached to Ordinance 323, as amended,
governing indemnification of employees and officers for damages payable
by virtue of a final judgment against them or settlement of litigation
and reimbursement for legal fees and costs.

The specific ordinances providing for participation in the Texas
Municipal Retirement System, as adopted by the city, are not included
in this chapter, but they are hereby specifically saved from repeal
and shall be maintained on file in the office of the city secretary.

The office of city administrator is hereby created and established.

The city administrator shall be appointed by the city council
for an indefinite period and shall be subject to discharge at the
will of the city council. Both appointment and discharge shall require
a majority vote of the city council.

The salary of the city administrator shall be determined from
time to time by the city council.

During the temporary absence or temporary disability of the
city administrator, the city council shall designate a properly qualified
person to perform the duties of said office.

The powers and duties of the city administrator shall be as
follows:
(1) To
devote all his/her working time and attention to the affairs of the
city and to be responsible to the mayor and city council for efficient
administration of the city’s affairs.
(2) To
see that all provisions of federal and state laws applicable to the
city are observed and that all local laws applicable to the city are
observed and that all local laws, ordinances and resolutions are enforced.
(3) To
attend all meetings of the city council with a right to take part
in discussions but having no vote.
(4) To
see that all contracts with the city, including public utility franchises,
are faithfully kept and performed and, upon knowledge of any violation
thereof, to call same to the attention of the city council.
(5) To
act as budget officer and keep the city council advised of the financial
condition of the city and future needs of the city.
(6) To
contract and expend the city’s funds in accordance with the
approved budget up to the sum of $5000.00.
(7) Supervise
and direct day-to-day activities of all city personnel and recommend
action (i.e., raises, hiring, firing, discipline, etc.) to the council
for further action.
