It is an offense for any person or entity to engage in outdoor burning or fires except as specifically outlined herein in the city limits. An offense under this section shall be a punished by a fine in accordance with the general penalty provided in section 1.01.009 of this code. Each day with any violation of this article shall constitute a separate violation.

(a) 
Open fires shall only be allowed only between the hours of one hour after sunrise and one hour before sunset.
(b) 
Open fires shall be permitted only on private residential property, with the consent of the owner or the person in charge of the property and attended by a person of at least 18 years of age for the duration of the burn. This person shall have a pressurized water hose at the burn site for fire control. Also, means of notifying 911 dispatch shall be made available.
(c) 
No person shall cause an open fire unless the surrounding ground shall be cleared of any combustible materials within a 20-foot radius of the location of the fire.
(d) 
The burn area must be no closer than 50 feet from any structure.
(e) 
Burning shall not be commenced when surface wind speed is predicted to be less than six miles per hour or more than 12 miles per hour during the burn period.
(f) 
Burning shall not be conducted during periods of actual or predicted persistent low-level atmospheric temperature inversions.
(g) 
Burning shall be commenced and conducted only when wind direction and other meteorological conditions are such that smoke and other pollutants will not cause adverse effects to any public road, landing strip, navigable water, or off-site structure.
(h) 
If at any time the burning causes or may tend to cause smoke to blow onto or across a road or highway, it is the responsibility of the permittee to post flagpersons on affected roads.
(i) 
Open fires shall be reported to the county sheriff’s office prior to any burning conducted.

Any outdoor fires or burning, whether accidental or purposefully set, are hereby prohibited in the city limits.

This prohibition shall not apply to outdoor burning activities related to public health and safety that are authorized by the state commission on environmental quality for:
(1) 
Firefighter training.
(2) 
Public utility, natural gas pipeline or mining operations.
(3) 
Harvesting of agricultural crops.
