Applicant
means a person who has filed a written application for a parade permit.
Chief of police
means the chief of police of the city, or his designated representative.
City manager
means the city manager of the City of Smithville, or his designated representative.
Parade
means any assembly, march, demonstration, ceremony, show, exhibition, procession or motorcade upon any public street, sidewalk, alley or other public property within the city consisting of three (3) or more persons, animals, or vehicles (or any combination thereof) with an intent of attracting public attention that interferes with or has a tendency to interfere with the normal flow or regulation of traffic upon public streets.
Parade permit
means written approval from the city manager or his designated representative for a parade.
Permittee
means the person to whom a parade permit is granted pursuant to this article.
Person
means any individual, sole proprietorship, assumed named entity, partnership, association, corporation or organization.
Public street
means the entire width of the publicly owned right-of-way.

(a) 
A person commits an offense under this article if he:
(1) 
Violates any provision of this article or fails to do an act required by this article;
(2) 
Stages, presents, or conducts any parade without first having obtained a permit as herein provided;
(3) 
Participates in a parade for which the person knows a permit has not been granted;
(4) 
Fails to comply with any condition of the parade permit;
(5) 
Hampers, obstructs, impedes, or interferes with a parade or with any person, vehicle or animal participating or used in a parade, except when reasonably required for the safe and orderly conduct of the parade, or for the safety and welfare of the general public; or
(6) 
Drives between the vehicles, persons or animals comprising a parade.
(b) 
Any person committing an offense under this article or any violation of state law or city ordinance is subject to immediate removal from the parade.
(c) 
A culpable mental state is not required for the commission of an offense under this article.

Any person found to be violating any term or provision of this article or otherwise committing an offense under this article shall be subject to a fine in accordance with section 1.01.009 of the city Code of Ordinances for each offense. Each day a violation continues shall constitute a separate offense.
