Portable type sanitary facilities may be required if determined
to be necessary by the city manager, and the applicant shall be responsible
for securing such facilities.

Waste from animals used in any such parade shall be removed
immediately following the completion of such parade.

(a) Any
parade or related activity desiring use of water from the city water
system must coordinate with the utilities department to obtain a temporary
meter. Deposit for the meter and payment for water used shall be in
accordance with ordinances of the city.
(b) The
applicant shall submit a plan for the disposal of wastewater and the
plan shall be approved by the city manager.

The applicant shall be required to make arrangements for the
collection of all waste resulting from such parade, and commercial
solid waste dumpsters may be required if determined to be necessary
by the city manager. If required, the applicant shall make arrangements
for the provision of such dumpsters with a commercial solid waste
disposal company currently having a franchise agreement with the city.

When loudspeakers will be used in conjunction with the parade,
the location and orientation of speakers shall be indicated along
with the planned hours of use. Speakers which are positioned so as
not to adversely affect an adjacent residential district may be used
between the hours of 7:00 a.m. and 10:00 p.m. when a parade permit
has been obtained. The city manager may modify the time limit for
use of such speakers when good cause is demonstrated by the applicant.

The city manager shall have the authority, when reasonably necessary,
to prohibit or restrict the parking of vehicles along a street or
highway or part thereof constituting a part of the parade route by
posting signs to such effect. It shall be unlawful for any person
to park or leave unattended any vehicle in violation of the parking
restrictions.

(a) Decision by chief of police.
The chief of police shall
determine whether and to what extent additional police protection
is reasonably necessary for the parade for traffic control and public
safety. The chief of police shall base this decision on the size,
location, duration, time and date of the parade, the number of streets
and intersections blocked, and the need to detour or preempt citizen
travel and use of the streets and sidewalks. If possible, without
disruption of ordinary police services or compromise of public safety,
regularly scheduled on-duty personnel will police the parade. If additional
police protection for the parade is deemed necessary by the chief
of police, he shall so inform the applicant for the parade permit.
The applicant then shall have the duty to secure the police protection
deemed necessary by the chief of police.
(b) Payment of costs.
In the event the chief of police determines,
upon a review of the application, that a parade may require the special
attention and involvement of city personnel or facilities, the chief
of police shall so notify the city manager. In such event, prior to
the issuance of a parade permit, the applicant and the city manager
shall agree upon the cost of policing and cleaning and the closure
of roads, and the applicant shall pay that amount to the city prior
to application approval. Prior to the issuance of a parade permit,
the applicant shall agree in writing to pay any additional costs to
the city within five (5) days of the date upon which the city informs
the applicant of the amount of such additional costs.

(a) A
parade shall not substantially interrupt the safe and orderly movement
of traffic near the parade.
(b) The
city manager has the right (but not the obligation) to postpone, cancel
or close early the parade because of hazardous weather or other acts
of God or for public safety and welfare. The city shall have no liability
for such postponement, cancellation, or closure. Further, the city
shall have no liability from the failure to postpone, cancel, or close
early the parade.
(c) A
parade shall move from its point of origin to its point of termination
without unreasonable delays en route.
(d) A
parade shall not interfere with proper fire and police protection
of, or ambulance service to, areas near the parade or unreasonably
require the diversion of police and fire protection and ambulance
service from other parts of the city.
(e) The
city, when reasonably necessary, may temporarily close or restrict
the use of city streets or other public property for a parade. The
city is authorized to install temporary traffic-control devices for
the temporary closure or restriction of city streets and public property
for a parade. It shall be unlawful for any person to disregard or
disobey any such temporary traffic-control device.
(f) Speeds
greater than 15 miles per hour by a vehicle in a parade are not reasonable
and prudent and are unlawful. A person operating a parade float or
other parade vehicle at a speed greater than 15 miles per hour is
subject to removal from the parade by a police officer.
(g) The
throwing, tossing, or distribution of candy, beads or other material
from a parade float or other vehicle is specifically prohibited. Candy,
beads, or other material may be distributed to spectators by walkers
adjacent to parade floats or other vehicles provided that such distribution
does not interfere with the orderly movement of the parade and no
spectators are required to move into the parade path to retrieve said
material. Any violation of this provision may result in the removal
of the parade float or vehicle from the parade.
(h) Any
rider or handler of any animal participating in the parade that shows
an inability to control their animal will be deemed unsafe by a peace
officer and shall be removed from the parade.
