(a) All
personnel matters will be administered by the city manager.
(b) Evaluations
of all employees will be approved by the city manager.
(c) The
city manager must obtain council approval of any pay increases to
department heads.
(d) This
section is to be adopted into the personnel manual, the police general
policy handbook, and city code books.

of April 8, 1991, establishing the city manager form of government,
with the conditions of employment to be provided by agreement with
the city manager.

The city manager shall appoint a qualified person to be confirmed
by the city council to serve as city secretary in accordance with
state law. Such appointee shall furnish a surety bond in a capital
stock company in an amount of $25,000.00 payable to the city for the
faithful performance of such officer’s duties. Said bond shall
be paid for by the city. The city secretary’s salary and expenses
shall be provided for in the annual city budget.

The city manager shall appoint a qualified attorney to be confirmed
by the city council to serve as city attorney for the city in accordance
with state law. Such appointee shall prosecute or defend any claims
or litigations of any kind or character for or against the city in
or out of court, when requested to do so by the city council or city
manager, and do and perform all other legal services requested by
the city council or city manager. Compensation for the performance
of services rendered by the city attorney shall be set by the governing
body of the city.

The office of city marshal of this city is hereby dispensed
with and abolished. All of the authority, duties and power vested
in the city marshal shall be hereby conferred upon and vested in the
city police chief, and said position is hereby created. The position
of city police chief shall be filled by appointment by the city council,
subject to approval by its city manager, under such terms and conditions
and remuneration as the city council and its city manager may direct.

(a) There
is hereby created and established the office of city health authority
for the city.
(b) This
office shall be filled by a competent, practicing physician who is
legally qualified to practice medicine under the laws of the state
and who is of reputable professional standing.
(c) The
city health authority shall be a resident of the state and the city.
(d) The
city health authority shall be appointed each year by the city manager,
subject to approval by the city council, shall serve at their pleasure
and shall receive as compensation one hundred twenty dollars ($120.00)
per annum.
(e) When
representing the city in health matters, he shall have the power and
authority of a peace officer.
(f) The
appointment of a city health authority is not effective until the
appointee has taken the oath of office and filed a copy of both the
oath and the appointment with the state board of health.

There is hereby created the office of building official/inspector.
One person, selected as under the respective ordinances provided,
may serve in the multiple capacity as building inspector, electrical
inspector, gas inspector and plumbing inspector. His salary shall
be designated by the city council. His duties being such as required
and defined under the present ordinances of the city, and any ordinances
that may be hereafter passed by the governing body thereof.

The city manager, with the approval of the city council, shall
employ other necessary employees to operate the utilities and functions
of the city as is reasonably necessary. The salaries and terms of
employment shall be regulated by the city council.
