1.1 
This ordinance shall conform to the City of Smithville Comprehensive Plan and shall be used to implement the Future Land Use Plan, which includes the Thoroughfare Plan, and the policies of the Comprehensive Plan. This ordinance shall govern every person, firm, association or corporation owning any tract of land within the corporate limits and extraterritorial jurisdiction of the City of Smithville who proposes to divide the tract into two or more parts for the purpose f laying out any subdivision of land or any addition to said City, or for laying out suburban, building, or other lots, and to lay out streets, alleys, squares, parks, or other parts of the tract intended to be dedicated to public use or for the use of purchasers, owners, renters, or other users of such partitions of the tract or lots fronting thereon or adjacent thereto.
1.2 
No land shall be subdivided within the corporate limits or the extraterritorial jurisdiction of the municipality until:
a. 
Approvals of the preliminary plat and final plat have been obtained from the planning and zoning commission, and
b. 
The approved final plat has been filed with the Bastrop County Clerk.
1.3 
No building permit or certificate of occupancy shall be issued for any parcel or plat of land which was created by subdivision after the effective date of, and not in conformity with, the provisions of this ordinance; and no excavation of land or construction of any public or private improvements shall take place or be commenced except in conformity with this section.
1.4 
The City of Smithville shall not serve or connect any land with water, sewerage, or electric service unless the owners of such land comply with this ordinance.

This ordinance is enacted by the City of Smithville for the following purposes:
(1) 
To implement the City of Smithville Comprehensive Plan through the regulation of subdivision development;
(2) 
To provide for the orderly development of the City and its extraterritorial jurisdiction;
(3) 
To ensure adequate provision for streets, alleys, parks, water and wastewater lines, storm drainage, and other facilities indispensable to the community;
(4) 
To ensure adequate fire protection and adequate access and egress for fire and other emergency services;
(5) 
To ensure access to adequate amounts of light and air; and
(6) 
To ensure the overall health, safety, and general welfare of the community.
