A certain document, a copy of which is on file with town clerk and authenticated, being marked and designated as the 2021 edition of the International Energy Conservation Code, as published by the National Code Council, is hereby adopted as the energy conservation code of the city for regulating and governing the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of energy conservation systems as herein provided, and providing for the issuance of permits and collection of fees therefor, and each and all of the regulations, provisions, penalties, conditions and terms of said energy conservation code on file in the office of the city clerk are hereby referred to, adopted, and made apart hereof, as if fully set out in this section, with the additions, insertions, deletions and changes, if any, prescribed in this division.

Any person who shall violate a provision of the International Energy Conservation Code or shall fail to comply with any of the requirements thereof, or who shall erect, install, alter or repair work in violation of the approved construction documents or directive of the code official or in violation of a permit or certificate under the provisions of this code or pursuant to the provisions in section 103 of Ordinance No. 0102 of the city (the zoning ordinance) shall be guilty of a misdemeanor, punishable by a fine in accordance with the general penalty provided in section 1.01.009 of this code Each day that a violation continues after due notice has been served shall be deemed a separate offense.

As used in throughout the International Energy Conservation Code, the term "code official" shall mean the building official as defined in article 9.02, division 4 of this code.

Nothing in this division or in the energy conservation code hereby adopted shall be construed to affect any suit or proceeding pending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act, ordinance or technical code hereby repealed as cited in the ordinance codified in this division, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this division.
