(a)
Prohibited.
It is unlawful to discharge any type of firearms within the incorporated area of the city.
(b)
Enforcement; exception.
The police department shall be empowered to issue citations for violations of this section as a result of observing a violation or responding to a signed complaint from a witness to a violation, with the exception of a licensed peace officer during the lawful performance of his duties.
(c)
Penalty.
A violation of this section shall be determined as having been done intentionally, knowingly, recklessly, or with criminal negligence. It shall further be deemed a misdemeanor and shall be punishable by a fine in accordance with the general penalty provided in section 1.01.009 of this code. Each occurrence may be deemed a separate violation and punished as herein contained.
