Property is described as being from the front curb of the property to the middle of the alley in the rear. Tall weeds and rubbish on or adjacent to properties are considered a nuisance. Weeds and vegetation are considered a violation if they are over twelve (12) inches tall and are uncultivated anywhere on or adjacent to a piece of property. Rubbish such as furniture, appliances, tree limbs, building material and other bulky items that are placed in the alley or on property shall be a violation of this article.

Property owners and tenants are responsible for keeping lawns mowed. Failure to do so may result in a citation and/or a bill for mowing if the city mows the weeds. Property owners are responsible for any rubbish that is located on their property regardless of who placed the items there.

Properties that are found to be in violation will be posted by an inspector and a notice of violation will be sent by regular mail to the property owner listed on the current tax records. Property owners shall have ten (10) days from the date the property is posted to take care of the violations that are cited. Properties that are not abated will be turned over to the municipal court and a citation may be issued.

Violations shall be a class C misdemeanor punishable by a fine in accordance with the general penalty provided in section 1.01.009 of this code. Each and every day shall constitute a separate violation.
