(a)
There is hereby created a planning and zoning commission consisting of five members who shall be residents of the town and registered voters thereof. No member of the planning and zoning commission may hold a state, federal, county or any elected office of any water or special utility district, or any voting entity affecting the town. Town council may waive the prohibition of holding an additional appointed position as stated herein by a vote of a 75% majority.

In addition to the five regular members of the planning and zoning commission, the town council may appoint up to four alternate members to said commission, and said alternate members shall have the same qualifications as regular members. Alternate members shall serve in the absence of one or more regular members. Alternate members shall be designated #1, #2, #3, and #4. In determining which of the alternate members shall serve in the absence of a regular member, the alternate member will be chosen on a rotating in-order basis starting with #1, then #2, then #3, then #4 then repeated as necessary in this order.

Members of the planning and zoning commission shall be appointed by the town council and shall serve for two-year terms or until their successors are appointed. The terms of the members of the planning and zoning commission shall be staggered with two commissioners being appointed one year and three commissioners being appointed the following year.

Members of the planning and zoning commission shall serve without compensation. However, the town council may authorize the payment of expenses for travel and meetings and similar costs which may be incurred by members incident to the performance of duties of members of the commission.

Members and alternate members of the planning and zoning commission may be removed for cause by a super majority vote of the town council before their terms of office expire.

During the first council meeting in September, the town council shall nominate and vote to fill the expiring terms of members of the planning and zoning commission. The town council shall also nominate and vote on the chairman of the planning and zoning commission from the members selected at this meeting. The planning and zoning commission shall elect a vice-chairman during the first meeting in September after a full commission is established. The planning and zoning commission will conduct meetings under Roberts Rules of Order as can be modified by the chairman.

The planning and zoning commission may meet as needed and requested by the chairperson or the majority of the members of the commission may direct.

Three (3) members of the planning and zoning commission shall constitute a quorum. However, no portion of the comprehensive plan referred to in section 1.04.040 shall be adopted by less than the affirmative vote of a majority of the entire commission.

The planning and zoning commission shall perform all functions necessary to carry out the intent of Tex. Gov’t Code section 211.001 et seq., V.T.C.A., relative to the preparation and adoption and amendment of a comprehensive zoning ordinance for the town, including the conduct of public hearings related thereto.

The planning and zoning commission shall perform all functions related to the review and approval of subdivision plats which may be assigned to it by the statutes of the state and ordinances of the town.

(a)
The planning and zoning commission shall prepare or cause to be prepared a comprehensive plan for the physical development of the town and its environs, including, but not limited to:
(1)
Land use and zoning;
(2)
Thoroughfares and transportation by rail, water, air, or highway;
(3)
Parks and school sites;
(4)
Public buildings;
(5)
Housing and neighborhood improvement;
(6)
Drainage;
(7)
Utilities and services;
(8)
Municipal expansion and annexation;
(9)
Slum clearance and blighted areas; and
(10)
Parking and use of streets and alleys.
(b)
The planning and zoning commission shall undertake through studies, consultation, and public hearings held in accordance with the provisions of state law and this division the preparation of a zoning ordinance defining specific districts and the uses permitted therein, provision for the enforcement and amendment of such zoning ordinance, and the preparation of an official zoning map for the town, to govern the physical development of the town. The planning and zoning commission is empowered to prepare and recommend to the town council an ordinance establishing subdivision regulations governing the planning and subdivision of land within the corporate limits of the town and within its extraterritorial jurisdiction as established by state law.

The planning and zoning commission shall recommend to and advise the town council on matters involving the physical improvement of the town.

The planning and zoning commission shall maintain a record of its meetings and report to the town council with its recommendations for the adoption of a zoning ordinance and subdivision ordinance for the town at such time as the comprehensive plan, the proposed zoning ordinance, and the subdivision regulations have been prepared and are ready for adoption by the town council.
