(a) 
If any driver or operator of a vehicle upon any public street or upon any drive in any public park, within the corporate limits of the city, shall, with negligence, as is defined in the Penal Code of this state in the title and chapter on negligent homicide, collide with or cause damage to any other vehicle of any kind whatsoever, or with any other property at any place within the corporate limits of the city, he shall be held guilty of negligent collision and misdemeanor.
(b) 
Proof of no intent on the part of any operator of any vehicle charged with an offense under this section to collide with any other vehicle or with any other property shall be no defense to any charge filed under the authority of this section.
(c) 
Nothing contained in this section shall authorize the prosecution of any person for the violation of the same while such person is operating any fire department or police department vehicle of the city in the performance of his duty, provided that it shall not be necessary in any complaint, action or proceeding under this section to negative this exception, but the same shall be proved by the defendant by way of defense.

It shall be the duty of the officers of the police department to investigate traffic accidents.

Whenever the accidents at any particular location become numerous, the police shall cooperate with the director of public works and the city manager in conducting studies of such accidents and determining remedial measures.

The police department shall annually prepare a traffic report which shall be filed with the city manager. Such report shall contain information on traffic matters of the city as follows:
(1) 
The number of traffic accidents, the number of persons killed, the number of persons injured, and other pertinent traffic accident data.
(2) 
The number of traffic accidents investigated and other pertinent data on the safety activities of the police.
(3) 
The plans and recommendations of the department for future traffic safety activities.
