The building which is a library building erected on the site described in Ordinance No. 74-1659 designated and marked with a plaque and letters as “The Unger Memorial Library,” the same being a gift from Mrs. Minnette K. Unger, shall perpetually be known and designated as the Unger Memorial Library and is hereby dedicated for the uses and purposes for which the same was given to the city by Mrs. Minnette K. Unger, and said site and building shall perpetually be used for the purposes for which same were given the city.

(a) 
The city council does hereby accept the designation of Unger Memorial Library as an area library under the Texas Library Systems Act of 1969.
(b) 
The city manager and the Unger Memorial Library board are hereby authorized and directed to do all those things necessary and expedient to join the state library system and to elect a representative to the organizational meeting of said library system.
(c) 
The service area of the Unger Memorial Library as an area library shall consist of those libraries qualified for membership in the system which have been assigned to Unger Memorial Library for interlibrary loan under the state library communication network.
(d) 
The services to the libraries assigned to Unger Memorial Library shall consist of those services now underwritten by the Unger Memorial Library’s LSCA Title One grant and such other services as may be prescribed by the state library and historical commission.
(e) 
The Unger Memorial Library advisory committee and the city manager are hereby authorized and directed to do all those things necessary and expedient to join the state library system and to qualify the Unger Memorial Library as an area library under the state library system; provided, however, any expenditure of funds not budgeted shall be first approved by the city council.
(f) 
The Unger Memorial Library advisory committee is hereby authorized and requested to elect a representative of the Unger Memorial Library as a delegate to the organizational meeting of the state library system, pursuant to the terms and provisions of House Bill 260-1969, 61st Legislature of the state.

There is hereby created the Unger Memorial Library advisory committee, hereinafter referred to as the “advisory committee.”
(2000 Code, sec. 14-16)
(a) 
The city librarian shall be an ex officio, nonvoting member of the advisory committee. The librarian shall be excused from those discussions concerning the salary or term of employment of that position.
(b) 
The city manager or his appointed representative shall be an ex officio member of the advisory committee, without voting privileges, and shall act in an advisory capacity to the committee.

Members of the advisory committee shall hold office for staggered terms of four (4) years and until their successors are appointed. There shall be no limit on the number of terms a member may serve, provided the member is reappointed by the city council.

Each member of the committee shall attend no less than 75% of the regular meetings called by the officers of the committee. The secretary of the committee shall make a quarterly report to the mayor and city council showing the attendance of each member of the committee. Any representative failing to attend 75% of the regular meetings legally called during any calendar year without an excused absence, as determined by a majority vote of the board members, shall be automatically disqualified for service on the committee and shall be replaced by the city council. Should any member of the committee move from the city or otherwise become disqualified for any reason, he/she shall be deemed to have vacated the office.

Upon the death, resignation, removal or expiration of the term of office of any member of the advisory committee, such vacancy shall be filled in the same manner by recommendation of the mayor and approval of the city council as is provided for the appointment of members to the committee.

In the event the best interests of the city require the removal of any member of the advisory committee, the removal shall be effected by appointment of a successor by unanimous vote of the city council.

The advisory committee shall, from its appointed members, elect a president and a vice-president.

The advisory committee shall encourage the development of the public library. It shall, subject to the review and approval of the city council, establish policies and programs for the library. The committee shall cooperate with all other public and private groups in advancing the best interests of the public library. It shall render to the city council all recommendations it considers advisable regarding the library.

The advisory committee shall advise with the city council concerning the preparation of a budget for the Unger Memorial Library for each year. These recommendations shall be submitted to the city manager on or before the first day of June of each year. This budget so recommended by the advisory committee shall be for the next succeeding fiscal year beginning October first and ending September thirtieth. All expenditures made by the Unger Memorial Library shall be made within the budget finally adopted by the city council for the operation of the library, and the total expenditures to be made for the operation of said library in any fiscal year shall be determined by the budget so approved and adopted by the city council.

All paid personnel of the library shall be city employees and shall be entitled to all benefits and policies of social security, retirement, vacation and other benefits and policies in accordance with the ordinances and regulations and policies of the city pertaining to its employees.

The advisory committee shall have the authority to make contracts with any other subdivision of the state, such as any other municipality or county, for the use of said library by members of the public residing outside of the city, and shall be authorized to accept payments and emoluments in consideration thereof; except, however, that no said contract shall be in derogation of the purposes of the Unger Memorial Library as designated by Mrs. Minnette K. Unger in the deed and instrument by which the site of said library was acquired. Neither shall it have the authority to enter into any such contract which is in violation of any existing city ordinance or state statute or federal law.

The advisory committee shall have the authority to fix minimum fees for regulatory purposes concerning said library, but none of which shall be such as to be in derogation of the purposes of said library, which is that of a public library, as provided as the purpose of same in the gift from Mrs. Minnette K. Unger. Any fees or other donations or emoluments from any contracts entered into with other municipalities or counties, or donations from organizations to said library, shall be, by the president of the advisory committee, deposited with the city secretary. All of such funds shall be, by the city secretary, placed in a separate fund to be known as the Unger Memorial Library Fund, and such funds shall not be used by the city for any purpose except for the operation and maintenance of the library and for the purchase of equipment, supplies, books or any other items that may be needed or useful in the operation and maintenance of the library. All expenses of the operation and maintenance of said library, within the budget for same or which may be designated as an emergency by the city council, shall, subject to the approval of the city council, either on the city’s general funds, or on the library fund or other appropriate fund. An audit of all receipts and expenditures made in any way in connection with the operation of the library shall be made for each fiscal year of the city, and a copy of same shall be furnished to the advisory committee and to the city.

The advisory committee shall make such rules and regulations as it may deem advisable concerning its parliamentary procedure and the duties of the librarian and other employees of the library, and the active management and supervision of the library shall be in accordance with the regulations and rules as may be made by the committee, all of which rules and regulations shall be subject to the approval of the city council.

The advisory committee shall make recommendations to the city council concerning each of their duties as herein by this article prescribed for the committee.
