The production, transportation, processing, handling, sampling, examination, grading, labeling and sale of all milk and milk products sold for ultimate consumption within the city or its police jurisdiction; the inspection of dairy herds, dairy farms, and milk plants; and the issuing and revocation of permits to milk producers, haulers and distributors shall be regulated in accordance with the provisions of the Texas Milk Grading and Labeling Law and the Texas Specifications and Requirements thereunder authorized, promulgated and certified to by the state health commissioner, and the applicable provisions of the 1965 Public Health Service Milk Ordinance and Code, Public Health Service Publication No. 229. Certified copies of the above, which are hereby adopted by reference, shall be filed in the office of the health inspector and the city-county health unit.

(a) 
Whenever the word “municipality” or the word “city” is used in the law, specifications and requirements adopted by the provisions of this division, it shall be construed to mean the city.
(b) 
Whenever the term “corporate counsel” or “city attorney” is used in the law, specifications and requirements adopted by the provisions of this division, it shall be construed to mean the attorney of this city.
(c) 
Whenever the word “health authority” is used in this division, the term refers to the director of the city-county health unit.

Any person who shall violate any provision of the law, specifications and requirements adopted by the provisions of this division shall be deemed guilty of an offense, and shall be punished as provided in section 1.01.009 of this code. Each day such violation continues shall be deemed a separate offense.

In the event of any conflict between the provisions of the law, specifications and requirements adopted by the provisions of this division and applicable provisions of this Code of Ordinances, state law or city ordinances, rules or regulations, the latter shall prevail and be controlling.

Only grade A pasteurized milk and milk products shall be sold to the final consumer, or to restaurants, soda fountains, grocery stores, or similar establishments in the city. Provided that, in an emergency, the sale of pasteurized milk and milk products which have not been graded, or the grade of which is unknown, may be authorized by the city health officer, who, as herein referred to, is the director of the city-county health unit.

It shall be the duty and the responsibility of the health authority to appoint and provide for inspectors or other employees who shall, acting under him, make all inspections and perform all such duties as the director may require in order to provide for the effective enforcement of the terms and provisions of this division.
