Anyone burning an open fire within the corporate limits of the city shall be considered guilty of a misdemeanor and fined up to $1,000.00 per offense, with each and every day being a separate offense.

(a) 
It shall be unlawful for any person to burn an open fire within the corporate limits of the city without first obtaining a burn permit.
(b) 
A person seeking a burn permit shall file an application with the chief of the fire department or his or her designee and shall pay a permit fee.
(c) 
The application must include:
(1) 
The name, address, telephone number, and date of birth of the person seeking to conduct the open burn.
(2) 
The location of the proposed open burn site with a description of the materials to be burned.
(3) 
A signed acknowledgment in a form acceptable to the city that the applicant shall be responsible for any damage resulting from the authorized burn.
(d) 
Upon approval of the application, the proposed burn site shall be inspected by the fire department. Upon inspection, the fire department may require that safeguards be implemented to contain and control the open burn. It shall be unlawful to initiate an open burn in violation of any safeguard mandated by the fire department.
(e) 
At minimum these safeguards shall consist of the following:
(1) 
Only dry plant growth natural to the burn site may be burned;
(2) 
The open fire must be at least 300 feet from any structure;
(3) 
There must be a 50-foot firebreak around the burn site;
(4) 
A competent person of at least 18 years of age must attend the fire at all times;
(5) 
There must be a water supply that is sufficient to control the fire;
(6) 
Burn hours shall be confined from sunrise to sunset;
(7) 
Materials may not be transported from another address to be burned;
(8) 
The applicant shall comply with the county burn day policy and other applicable laws;
(9) 
The applicant shall notify the fire department at least 24 hours in advance of the burn;
(10) 
The fire chief or his or her designee may suspend the burning at any time and shall adopt any additional rules deemed necessary; and
(11) 
Burning may be conducted only during daylight hours.
(f) 
It shall be unlawful to burn the following materials under any circumstances:
(1) 
Petroleum products;
(2) 
Asphalt material;
(3) 
Items containing natural or synthetic rubber;
(4) 
Lumber; and
(5) 
Cardboard or household garbage.
