Any person, firm or corporation violating any provision of this
article shall be deemed guilty of a misdemeanor and, upon conviction,
shall be fined any sum of not more than $500.00. Each and every day
that the violation continues shall constitute a separate and distinct
offense and shall be treated as such.

(a) It
shall hereafter be unlawful for any person, firm or corporation to
obstruct or encumber, to any extent, any portion of any street, alley,
sidewalk, drainage ditch or any area designated a street, or any other
public ground in the city, with lumber, boxes, timber, firewood, posts,
vehicles or anything whatever, in any manner whatever, for more than
a reasonable period of time, but not to exceed 72 hours. Overnight
parking of motor vehicles shall not be permitted in a manner as to
block or obstruct any portion of any street, sidewalk, alley or drainage
ditch.
(b) It
shall be unlawful for any person, firm, or corporation to paint or
make any permanent mark on any public street, sidewalk, fire hydrant,
street sign, lamp post or any other public property or fixture unless
authorized to do so in this code.

It shall hereafter be unlawful for any person, firm or corporation
to place any barrel or barrels, box or boxes, wood, merchandise, vehicle
or other substances on any sidewalk in the city, so as to obstruct
entirely or block passage along the sidewalk preventing compliance
with state accessibility statutes. No one shall have or maintain any
fruit stand, huckster’s stand or other stall upon any sidewalk
in the city without proper permitting.

Where any such objects as mentioned in sections
8.05.002 and
8.05.003 may be found by the city code enforcement officer or peace officer or reported to him or her by proper complaint, it shall be the duty of the officer to notify the owner of the objects to have the objects removed by the owner immediately, and if the objects are not removed immediately it shall be the duty of the officer to file a complaint in the municipal court of the city against the responsible person or party. This complaint may be in the form of a citation or a complaint filed at large to the municipal judge.
