(a) 
Definitions.
The following words, terms, and phrases, when used in this section shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Golf cart.
The meaning assigned by the Texas Transportation Code section 502.001(7), as it exists or may be amended and includes a motor vehicle designed by the manufacturer primarily for transporting persons on a golf course.
Public highway.
The meaning assigned by the Texas Transportation Code section 502.001(18), as it exists or may be amended and includes a road, street, way, thoroughfare or bridge:
(1) 
That is in this state;
(2) 
That is for the use of vehicles;
(3) 
That is not privately owned or controlled; and
(4) 
Over which the state has jurisdiction under its police power.
(b) 
Golf carts prohibited.
A person, other than public safety personnel, may operate a golf cart on a public highway if:
(1) 
The maximum speed limit on the public street is 35 miles per hour or less;
(2) 
The person has a valid driver license;
(3) 
The person maintains current financial responsibility for the golf cart, as required of other passenger vehicles in the V.T.C.A., Texas Transportation Code section 601.051;
(4) 
The person complies with all applicable federal, state, and local laws and ordinances;
(5) 
The golf cart has the following equipment:
(A) 
Headlamps;
(B) 
Tail lamps;
(C) 
Reflectors;
(D) 
Parking brake;
(E) 
Mirrors; and
(F) 
A slow-moving vehicle emblem; and
(6) 
While the golf cart is in motion, the driver and every passenger in a golf cart is seated in a seat designed to hold passengers. No person may stand or ride in the lap of the driver and/or other passenger of a golf cart while it is moving.
(c) 
Public safety personnel may operate a golf cart on any public street without any further restrictions when the golf cart is used in the performance of his/her duties.

(a) 
Definitions.
For the purposes of this section, the terms below shall have the following meanings:
Engine brake.
Any device used to slow a vehicle by slowing the engine, which is also commonly called, among other names, engine brake, compression brake, jake brake and dynamic brake, regardless of the manufacturer.
Vehicle.
A device that can be used to transport or draw persons and/or property on a highway or street including but not limited to a car, truck, trailer, truck-tractor, semi-truck, tractor-trailer, 18-wheeler or motorcycle.
(b) 
Unlawful use; offense established; nuisance established.
It shall be unlawful for the driver of any vehicle to use or operate or cause to be used or operated within the city limits, as they may presently or in the future exist, any engine brake. A person commits an offense by violating any provision of this section. The use of an engine brake is hereby declared a nuisance.
(c) 
Signs.
The city manager, or his/her authorized representative, shall be responsible for installing signs and/or markings to properly notify the public that the use of engine brakes is prohibited within the city, and/or the city manager, or his/her designee, shall cooperate with and assist the state department of transportation in installing such signs and/or markings.
(d) 
Enforcement.
The police chief, or his/her authorized representative, is authorized to issue citations to any driver or owner of a vehicle who has violated this section. The city shall not be responsible or liable for any damage to any vehicle or personal property caused by the prohibition on the use of engine brakes pursuant to this section and shall not be responsible for any damage resulting from the failure to exercise the authority granted under this section.
(e) 
Defense established.
It shall be a defense to prosecution for an offense established by this section if the use of engine brakes was necessary to avoid imminent danger to persons or property.
(f) 
Exemption.
Fire pucks and related emergency service vehicles engaged in emergency related duties shall be exempt from this section.
