(a) Restrictions; irrigation systems.
(1) Outdoor watering with sprinklers is prohibited from 10:00 a.m. to
6:00 p.m. every day from June 1 through September 30. (Resetting of
watering times in sprinkler systems is recommended to comply with
the water schedule. Watering with hand-held hoses, soaker hoses, or
dispensers is allowed.)
(2) All new irrigation systems are required to include rain and freeze
sensors capable of multiple programming.
(3) All new irrigation systems are required to be in compliance with
state design and installation regulations (Tex. Admin. Code title
30, part 1, chapter 344).
(4) Irrigation systems that spray directly onto impervious surfaces or
onto other non-irrigated areas are prohibited. (Wind-driven water
drift will be taken into consideration.)
(5) Outdoor watering during any form of precipitation is prohibited.
(6) Fugitive water flow is prohibited.
(7) No person or facility or operation shall cause or permit the flow
of excess or fugitive water onto any adjacent property or public right-of-way.
(b) Penalty; injunction.
Any person violating any of the
provisions of this section shall be deemed guilty of a class C misdemeanor
upon conviction and shall be fined, except as otherwise provided herein,
in a sum not to exceed $500.00 for each offense, and a separate offense
shall be deemed committed upon each day during or on which a violation
occurs or continues. If the governing body of the city determines
that a violation of this section creates a threat to the public safety,
the city may bring suit in the county district court in which the
person who committed the offense resides or has an office to enjoin
the person, firm, partnership, corporation, or association from engaging
in the prohibited activity.
