The following terms as used in this division are defined as follows:
Gambling device.
Any machine, instrument, device or thing used or operated, or which may be used or operated, for the purpose of gambling, or for playing any game of chance for money or any other article or thing of value.
Marble machine.
Every coin-operated marble machine, marble table machine, marble-shooting table, or marble machine of any description, or any pinball machine, whether enumerated or not, and for the playing of which a fee is charged, regardless of whether such machine be used for the purpose of amusement, entertainment, or for vending commodities, merchandise, confections, or services of any kind, and which is operated by coins, slugs or tokens of any sort.
Slot machine.
Any machine, instrument, device or thing which is used or operated, or which may be used or operated, by the insertion of any coin, slug or token, and which, as a result of certain combinations of numbers, symbols, pictures or any other items, may entitle the player to any money, slugs, tokens, merchandise or any other article of value as a prize or reward resulting from the operation of such machine, instrument, device or thing, the player having no control over such prize or reward and no skill on his part being involved. The fact that such machine, instrument, device or thing may also vend merchandise shall be immaterial, and the vending of such merchandise in any manner shall not take such machine out of the foregoing definition of a slot machine.

It shall be unlawful for any person, firm or corporation to set up for operation, operate, lease, exhibit, or distribute for the purpose of operation or exhibition, any gambling device or slot machine, as those terms are defined in section 4.02.061.

No marble machines shall be permitted within five hundred (500) feet of any school building.

No person may engage in the operation for profit of any marble machine within the city on weekdays between the hours of 11:00 p.m. and 10:00 a.m., provided, that on Saturdays said establishment may stay open until 12:00 midnight; and further provided, however, that such marble machine may be operated on Sunday only between the hours of 1:00 p.m. and 6:00 p.m.

The sale of alcoholic beverage or beverages in or on the premises licensed hereunder is prohibited. No person, firm, association of persons, corporations, and any other organizations authorized under the laws of the state, licensed hereunder, shall knowingly permit the sale, use or consumption of any kind of alcoholic beverage or beverages in or upon the premises for which a license has been issued, as provided in this division.

The city council is hereby authorized and empowered to revoke or cancel the license of any person, firm, association of persons, corporations and every other organization authorized under the laws of the state, licensed to own and operate a gambling device, slot machine or marble machine, after giving such licensee ten (10) days’ notice of a hearing and after conducting such hearing for the purpose of determining whether such license should be revoked; provided, however, that such power of cancellation or revocation shall be exercised only under the following conditions:
(1) 
For the violation of any of the provisions of this division.
(2) 
For knowingly permitting the sale, use or consumption of any alcoholic beverage or beverages in or upon the premises licensed.
(3) 
For violation of the prescribed hours of operation provided in section 4.02.064.
(4) 
For knowingly permitting the presence on the premises of a person or persons under the influence of intoxicating liquor.
(5) 
For knowingly permitting disorderly conduct or immoral practices on the premises.
(6) 
For knowingly permitting the violation of the law or laws of the state or of the ordinances of the city.

It shall be unlawful to erect or construct on the licensed premises, any partition or partitions obstructing the view of any part of the building or premises licensed herein, or cutting the building into two or more rooms by constructing partitions therein, in which a marble machine is or are displayed, owned and operated for profit; provided, however, that toilets or other sanitary facilities shall be enclosed and adequately ventilated in accordance with health, plumbing, sanitary and other applicable ordinances of the city.

Places of business governed by this division shall be located on the ground floor or street level only of any building and shall not be licensed for any other floor than the ground or street level floor.

The city manager shall appoint or designate the city building inspector to make periodic inspections of the licensed premises, whose duty shall be to determine compliance with the building provisions, the maintenance of toilets and other sanitary facilities and compliance with the health, plumbing, sanitary and other applicable ordinances of the city.
