The title of this chapter shall be the "NHBP Hunting and Trapping."
The purpose of this chapter is to:
A. 
Regulate the harvesting of wildlife and vegetation on the Tribe's Reservation lands and Tribal Fee lands to ensure that hunting is conducted in ways that are safe for those persons hunting and that wildlife and vegetation populations are managed at sustainable levels.
B. 
Initiate a permit system to be administered by the Tribal Police Department to regulate hunter numbers on all tribal properties to minimize user conflicts.
C. 
Promote the health, safety and general welfare of the Tribe, its citizens and visitors to the Tribe's Reservation.
D. 
Protect and reinforce traditional lifestyles and culture by protecting the natural environment of tribal land, its forests, wildlife, and natural resources.
If any provision of this chapter is found to be unconstitutional or unlawful by the courts of the Tribe or the federal courts, such provision(s) shall be struck, and the remainder of this chapter shall continue in full force and effect.
This chapter and any amendments shall take effect immediately upon its enactment by resolution of the Tribal Council.
A. 
Territorial jurisdiction. Jurisdiction of this chapter extends to all lands intended for hunting as may be within the Tribe's Reservation or other lands owned in fee by, or held in trust for, the Tribe.
B. 
Jurisdiction is extended over:
(1) 
All persons within the territorial jurisdiction of the Tribe who hunt on reservations lands or lands owned in fee by the Tribe; and
(2) 
All persons hunting or assisting a hunter, or any other person within the territorial jurisdiction of the Tribe, whether a tribal member, an Indian who is not a tribal member, or a non-Indian.
A. 
Tribal laws: To the extent this chapter may conflict with other tribal codes which have been enacted to comply with statutes or regulations of any agency of the United States, such tribal codes may govern over the provisions of this chapter if such other tribal codes apply to the specific circumstance and are clearly in conflict with the provisions of this chapter. In all cases, this chapter shall be interpreted in a manner that best preserves the peace, safety and general welfare of the Tribe and tribal members.
B. 
Federal laws: Where a conflict may appear between this chapter and any applicable federal law, the federal law shall govern only if it has specific applicability and is in clear conflict with the provisions of this chapter.
C. 
State laws: To the extent that the laws of the State of Michigan may be applicable to the subject matter of this chapter, they will be advisory only and not directly binding and shall not govern the relations of the parties.
A. 
In its interpretation and application, the provisions of this chapter shall be held to be minimum requirements and shall be liberally construed in favor of the Tribe and shall not be deemed as a limitation upon or repeal of any other tribal power or authority.
B. 
Nothing in this chapter is intended to or shall waive any rights of the Tribe, of any nature whatsoever, reserved under any treaty or otherwise provided for under federal law.
C. 
Nothing in this chapter is intended to or shall grant, expand or confirm, in any way whatsoever, the jurisdiction of the State of Michigan, or any other prohibitions, limitations and requirements pertaining to hunting, trapping, fishing, gathering, or other usufructuary activities which are made applicable under this chapter and extended solely as a matter of tribal law.
D. 
Nothing in this chapter is intended to or shall serve as a concession or admission, of any nature whatsoever, regarding the jurisdiction of the State of Michigan or any burden arising from compliance with any state law.
The Tribe declares that there is no liability of the part of the Tribe, its agencies, agents or employees for any damages which may occur as a result of any person's reliance upon this chapter or any action taken by other officials, employees or agents of the Tribe in the administration of this chapter. The Tribe by the adoption of this chapter does not waive its sovereign immunity in any respect.
