The office of the city manager shall be under the direct supervision
of the city manager, who shall have the authority to select and nominate
the personnel in the office. The city manager shall be appointed by
the city council. The duties shall be as prescribed by the city council.
All powers which are conferred on the city manager may be exercised
by the personnel in the department to whom such authority is delegated
by the city manager. In the absence of the city manager and a deputy
city manager, an assistant city manager may upon delegation assume
responsibility for the office. Subject to any law and/or city charter
requirement, a deputy city manager may be appointed, who shall assume
the authority and responsibility for the departments described by
resolution.

The legal department, as now established, is hereby continued.

There is established the public safety communications department.
Subject to certain restrictions, as hereinafter set forth, the direct
supervision of the department of public safety communications shall
be under the direct supervision of the director of public safety communications,
who shall select, prescribe duties, and nominate the personnel in
the department as are provided for by the budget. The director of
public safety communications shall be appointed by the city manager.
All powers which are conferred on the director may be exercised by
other personnel to whom such authority is delegated by the director.
In order for personnel in the department of public safety communications
to have access to criminal history record information maintained by
the department of public safety in the TCIC/NCIC computer system,
the chief of police of the police department of the city, a criminal
justice agency, shall maintain “management control” over
the TCIC/NCIC system and users of the system as interpreted by the
department of public safety and/or FBI and as required by any current
TLETS management control agreement. Such management control shall
include supervision over the TCIC/NCIC equipment and control over
the selection and supervision of personnel with access to the TCIC/NCIC
computer system as is necessary to insure compliance with the operating
protocol for the systems adopted by the chief of police.
