No person, persons or organization shall use a Borough highway for a procession, assemblage, special event or race, which will close or partially close the highway, unless a permit has been obtained from the Borough Council following the submission of an application therefor on a form prescribed by the Borough Council.
The closure of a Borough highway for the purpose of assemblage may be permitted, provided the following requirements are met:
A. 
The highway is not an arterial highway as the same is defined in Chapter 170, Subdivision and Land Development, of this Code.
B. 
Adequate alternate route(s) can be established for detouring traffic around the closed route.
C. 
Adjacent properties will not be adversely affected by the highway closure or partial closure.
D. 
Person or persons requesting a permit to close a Borough highway for purposes of a block party, in addition to all other standards set forth, must obtain the signatures of 75% of the residents bordering on the highway to be closed before a permit will be issued.
E. 
A review of previous similar closures indicates no substantial problems or citizen complaints resulting from such closure.
F. 
The closure or partial closure will not unduly interfere with proper fire and police protection or ambulance service in the area. This decision shall be entirely discretionary with the Borough Chief of Police.
A. 
The cost of a permit, required by § 184-6, shall be $150 with $50 of that amount designated as a refundable deposit upon completion of the event, provided no damage to any traffic control device or any other damage resulting therefrom occurs.
B. 
If police services are requested or required, the sponsor of the procession, special activity, race or assemblage shall reimburse the Borough for all costs for police services and/or fire police services.
The person or persons requesting the closure or partial closure shall complete an application at least 21 days prior to the scheduled procession, special activity, race or assemblage which contains at least the following:
A. 
The person or persons requesting the closure agrees to fully indemnify, hold harmless and, if requested, defend the Borough of Sinking Spring and all Borough of Sinking Spring employees and assure all liability for damages or injury occurring to any persons or property through, in or as a consequence of any act or omission of anyone associated with the highway closure or partial closure.
B. 
In the case of assemblages, signage and barricades will be provided by the Borough and placed at the location at least 24 hours prior to the event. It shall be the responsibility of the person or persons requesting the closure to place the delivered signage and barricades in accordance with the permit.
C. 
All persons shall comply with all permit directions and conditions and with all applicable laws and ordinances.
D. 
The Chief of Police, or his designee, shall have the authority to revoke a permit issued upon a violation of the standards for issuance.
