(a) The city does hereby adopt the provisions of article 6701d of the
Civil Statutes of the state, more commonly known as the Uniform Act
Regulating Traffic on Highways or the Uniform Traffic Code, as heretofore
amended and as same may be hereafter amended, as the uniform traffic
code of the city, hereinafter referred to as the “traffic code,”
insofar as said provisions of article 6701d are applicable to the
matters of traffic and all other related purposes, except as same
may be amended or changed herein and hereby or by subsequent action
of the city council. In order that there will be no question, it is
the intent hereof that all provisions of article 6701d, as same presently
exist or as same may be hereafter amended, pertaining to traffic and
traffic matters shall hereafter be the law of the city except as same
may be changed.
(b) Wherever reference is made in article 6701d to the state highway
department or the state highway commission, where necessary to conform
to the intent of this section, the same shall be construed to mean
the city council.
(c) Notwithstanding the provisions of article 6701d, it is expressly
understood that the mayor of the city shall have the power, after
doing such investigative work as he may deem necessary or appropriate
and after consultation with the chief of police either with or without
specific action on the part of the city council, to designate the
applicable speed limits for the city in certain zones or areas where
same shall not be consistent with state law, that is, thirty (30)
miles per hour, and to further designate school zones or any other
zones which may be necessary to be zoned for the safety and general
welfare of the citizens of the city, except, of course, that this
power cannot be exercised in connection with any state highway or
any other highway in which the state or any agency thereof has jurisdiction
and control. In order to implement and carry out the applicable speed
limits designated and any zones established, the mayor is hereby authorized
and directed to place, install and erect such signs or other traffic-control
devices, including, but not limited to, automatic signal-control devices,
in any and all areas of this city.
(d) If any person, firm, corporation or any other legal entity should violate any of the provisions of this chapter, such act of violation shall be considered as a misdemeanor offense, and upon conviction the punishment shall be a fine in accordance with the general penalty in section
1.01.009 of this code.
Editor’s note–Since adoption of this
provision, the regulations contained in the Uniform Act Regulating
Traffic on Highways (V.T.C.S., article 6701d) have been recodified
and are now located in V.T.C.A., Transportation Code.
