Any person found guilty of any violation of the provisions of this article shall be guilty of a misdemeanor and shall be fined as provided in section
1.01.009 of this code. Each and every day of a violation of the provisions of this article shall be deemed a separate offense.

Any and all vacant land or buildings or structures that will
be used for any type or kind of commercial and/or industrial business
or purpose shall obtain an occupancy permit issued by the city secretary
prior to using any such vacant land and/or buildings or structures
for any type or kind of commercial and/or industrial business or purpose.

This article shall exclude all residential dwellings.

The owner and/or lessee or an agent of or for the owner and/or
lessee of any vacant land and/or buildings or structures that will
be used for any commercial and/or industrial purpose shall make application
for an occupancy permit at the city hall.

The applicant for an occupancy permit shall give full disclosure
of the purpose for which such vacant land and/or building or structure
is to be used; shall give the complete address as to number, street,
lot, block and addition, the type of commercial or industrial business,
and the name that the business will be known as; and shall certify
by signature that he/she/they will not nor will they permit any other
person or persons to use the described property for any purpose [other]
than that stated on the occupancy permit.

The city secretary will insure that the following inspections
(as applicable) of the vacant land and/or buildings or structures
are made: building, electrical, plumbing, fire, health, police or
any other applicable inspection that may pertain to the operation
of such stated commercial or industrial use, and shall insure that
the provisions of the city zoning ordinance are in full compliance.

If for any reason the vacant land and/or buildings or structures
do not pass all applicable inspections stated above or such land or
buildings or structures do not comply with the zoning ordinance, an
occupancy permit will not be issued.

The city secretary will insure that all federal, state, county,
and city permits, licenses, or certificates that pertain to that particular
commercial and/or industrial use have been obtained and are valid.

The city secretary shall issue an occupancy permit only when
all of the provisions of this article are in full compliance.

If all of the provisions of this article are not in full compliance
an occupancy permit cannot and will not be issued and public utilities
(such as gas, electrical, water, sewer, sanitation, and telephone)
will not be permitted to be used or connected to such vacant land
and/or buildings or structures.

No refund shall be made of any occupancy permit fee by the city
for any reason whatsoever.

(a) This
article shall not apply to any commercial and/or industrial uses or
businesses that are in operation on the effective date of this article.
(b) This
article shall apply fully to all commercial and/or industrial uses
or businesses that come into operation after the effective date of
this article.
(c) All
commercial and/or industrial businesses that are in operation on the
effective date of this article that later change ownership or change
in any way the use or purpose of such business shall require an occupancy
permit.

No change will be made to any building or structure or in the
use of any building or structure or premises which is inconsistent
with the occupancy permit. Additions to or structural alterations
of any nonconforming building or structure are strictly prohibited.
