ORDINANCE NUMBER 2001-02
AN ORDINANCE OF THE CITY OF HUDSON OAKS, TEXAS, REPLACING THE
ZONING ORDINANCE TEXT AND MAP OF THE CITY OF HUDSON OAKS, TEXAS, BY
REPEALING ORDINANCE NO. 1282-01, AS AMENDED AND REPLACING SAID ZONING
ORDINANCE AND MAP WITH THE ZONING ORDINANCE AND MAP ATTACHED HEREIN;
PROVIDING FOR GENERAL PROVISIONS; PROVIDING FOR PERMITTED USES; PROVIDING
FOR ZONING DISTRICTS; PROVIDING FOR SUPPLEMENTARY REGULATIONS; PROVIDING
FOR ADMINISTRATION; PROVIDING FOR DEFINITIONS; PROVIDING A SEVERABILITY
CLAUSE AND AN EFFECTIVE DATE.
WHEREAS; the City of Hudson Oaks, Texas, is a Type “A”
General Law municipality acting under the authority vested by state
law; and
WHEREAS; the City is authorized by Section 211.005, “Districts”
of the Texas Local Government Code to zone property into districts;
and
WHEREAS; the City Council of the City of Hudson Oaks deems it
necessary in order to lessen congestion on streets, to secure safety
from fire, panic, and other dangers; to promote health and the general
welfare; to provide adequate light and air; to prevent overcrowding
of land; to avoid undue concentration of population; to facilitate
the adequate provisions of transportation, water, sewers, schools,
parks and other public requirements; to conserve the value of property
and encourage the most appropriate use of land throughout the City,
that the hereinafter contained provisions of this ordinance should
be passed, promulgated and enforced; and
WHEREAS; the City Council deems it necessary to repeal Ordinance
No. 1282-01, the Zoning Ordinance of the City of Hudson Oaks, as amended,
and replace it with the zoning regulations contained herein; and
WHEREAS; the Planning and Zoning Commission has conducted a
series of workshops with the planning consultant to review and develop
zoning regulations; and
WHEREAS; the Planning and Zoning Commission and the City Council
have conducted joint workshops to review and provide further input
regarding the developed zoning regulations; and
WHEREAS; the City Secretary has given published notice of a
joint public hearing with the City Council and Planning and Zoning
Commission and said public hearing was held on May 24, 2001, as required
by law.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF HUDSON OAKS, TEXAS:
SECTION 1
That Ordinance No. 1282-01, the Zoning Ordinance of the City
of Hudson Oaks, Texas, as amended, is hereby repealed and replaced
with the regulations contained herein.
SECTION 2 - SAVINGS
This Ordinance shall be cumulative of all other ordinances of
the Town [City] affecting the regulations of land and zoning and shall
not repeal any of the provisions of those ordinances except in those
instances where the provisions of those Ordinances are in direct conflict
with the provisions of this Ordinance.
SECTION 3 - PENALTY
It shall be unlawful for any person to violate any provision
of this Ordinance, and any person violating or failing to comply with
any provision hereof shall be fined, upon conviction, in an amount
not more than Two Thousand Dollars ($2,000) and a separate offense
shall be deemed committed each day during or on which a violation
occurs or continues, as also stipulated in Section 45.2 of the attached
zoning ordinance.
SECTION 5 - EFFECTIVE DATE
This Ordinance shall take effect immediately from and after
its passage and publication in accordance with the provisions of the
laws of the State of Texas.
PASSED AND APPROVED on this 24th day of May, 2001 at a joint
meeting of the City Council and Planning and Zoning Commission of
the City of Hudson Oaks, Texas.
