12.1 
DESCRIPTION OF LAND USE TABLE CONDITIONS AND SPECIAL REGULATIONS
The following describe conditions and special regulations for uses listed in the Permitted Use Table. Additional requirements may be added to these herein by the Planning and Zoning Commission or City Council as deemed necessary to protect the health, safety, and general welfare of the citizens of Hudson Oaks. No construction or occupancy shall commence for any permitted use until the conditions herein stated or required by the Planning and Zoning Commission and City Council have been met.
a. 
A site plan will be required in accordance with Section 24 Site Plan Requirements.
b. 
A site plan, in accordance with Section 24 Site Plan Requirements, will only be required in districts which require a Specific Use Permit.
c. 
All storage shall be within completely enclosed buildings or effectively screened with screening not less than six feet nor more than eight feet in height, provided no storage located within 50 feet of such screening shall exceed the maximum height of such screening.
d. 
Temporary buildings for construction purposes for a period not to exceed the duration of such construction.
e. 
May not be located within 300 feet of any property zoned for a residential use or any property which is occupied by a church, public school, day care or nursing home. The measurement of distance shall be measured as a radius from the edge of the property line.
f. 
Permitted on a temporary basis only, in accordance with Section 30 Temporary Uses and Special Events.
g. 
All outdoor lighting, including parking lot lighting, shall be directed away from any property zoned or developed for residential uses.
h. 
Any proposed stable or barn must be set back 150 feet from the property line. Only animals permitted within the corporate limits by the City Code will be permitted on-site.
i. 
Pens, outdoor kennels, or animal runs must be located 75 feet from any neighboring residential structure.
j. 
A copy of the State Certification of licensing or registration as described in Section 42.052 of Chapter 42 - Texas Human Resources Code must be provided to the City.
k. 
Shall not be used for the storage of wrecked vehicles, or the dismantling of vehicles or the storage of vehicle parts.
l. 
All vehicles being stored for repair shall be screened from all public rights-of-way.
m. 
All equipment shall be stored and displayed on a hard all-weather surface.
n. 
Antenna and towers shall be permitted and regulated in accordance with Section 36 Wireless Communications Facilities.
o. 
Public or private radio, television, or telecommunication towers over thirty-five feet (35') in height require a Specific use permit, as provided in Section 25, Specific Use Permit.
p. 
Accessory Dwelling/Garage Apartments are limited to a maximum of 500 square feet.
q. 
Any business which uses the operation of motor vehicles on-site, such as go-cart tracks, shall not be located within 500 feet from any residentially zoned property.
r. 
As regulated by Ordinance 1992-13[.]
s. 
Requires 50 acres for animal hospital in SF-2A.
t. 
Must comply with Chapter 241 of the Texas Local Government Code[.]
u. 
Temporary or Seasonal Restaurants and refreshment stands, in addition to any other conditions established for an applicant following a hearing on an application for a special use permit, must comply with the following minimum standards with no variances allowed:
(1) 
Any structure must be located behind the actual building line of the main structure located on the property.
(2) 
Any structure must be skirted with a material substantially similar to the building material of the structure.
(3) 
No more than two (2) signs may be permitted: an identifying sign which may be two-sided but may which not exceed 16 square feet in total sign structure area, and menu wall sign for patrons which may not exceed 8 square feet.
(4) 
When a structure is moved from an approved lot, it may not be relocated thereon for a period of at least 30 days from the day such structure was moved.
(5) 
Applicants must pay a $50.00 inspection fee for each time that a structure is located or relocated on a site.
(6) 
Dedicated, marked parking must be provided for four (4) vehicles, and must be adjacent to the temporary or seasonal structure. If the main use of the lot does not comply with the minimum parking space requirement of this or any amending ordinance, the temporary or seasonal use shall not be granted a special use permit.
(7) 
No structure may be permitted on a lot less than one (1) acre in size.
v. 
Any establishment that derives seventy-five percent (75%) or more of the establishment’s gross revenues from the on-premises sale of alcoholic beverages must meet the following conditions, in addition to any other conditions established for an applicant following a hearing on an application for a special use permit:
(1) 
Such establishment must be located in the Industrial “I” or General Commercial “GC” district;
(2) 
Such establishment shall not be located within one thousand (1,000) feet of a church, public or private school, public hospital, day care center, child care facility, public park or recreational facility, measured along the property lines of the street fronts and from the front door to front door, and in a direct line across intersections;
(3) 
Such establishment shall meet the following parking requirements:
A. 
One (1) parking space is required for every three (3) seats or for every seventy-five (75) square feet of floor area, whichever is greater;
B. 
All driveways, approaches and surfaces of parking areas must be constructed of concrete, hot-mix asphalt paving, or other hard surface material approved by the City Administrator;
C. 
Safety barriers, protective bumpers or curbing shall be provided to prevent encroachment onto adjoining public or private property;
D. 
The location and traffic direction of all access drives, and internal circulation patterns, shall be designed and maintained in accordance with accepted principles of traffic engineering and traffic safety; and
E. 
Lights must be provided to illuminate any parking facility or paved area, shall be designed to reflect away from adjoining public or private property, and must fully comply with the City’s outdoor lighting requirements contained in Section 33 of the Zoning Ordinance.
(4) 
The exterior building wall construction of such establishment must be one hundred percent (100%) masonry, exclusive of all windows, doors, roofs and glass construction material;
(5) 
Such establishment must meet all fire protection requirements of all applicable codes, including fire suppression/sprinkler system requirements;
(6) 
No pole signs shall be permitted;
(7) 
No illuminated, moving, flashing or neon signs;
(8) 
No signs advertising or depicting alcohol or tobacco shall be visible from the right-of-way;
(9) 
All required state licenses or permits must be valid and in effect;
(10) 
All sales and consumption must be within permanent walls of the establishment covered by a roof; no outside consumption of an alcoholic beverage is permitted.[;]
(11) 
No amplified music or loudspeakers outside the building is permitted;
(12) 
Such establishment must be at least four thousand (4,000) square feet in size and must meet all applicable codes;
(13) 
A specific use permit will terminate upon change of ownership of the holder of the specific use permit, and is not transferable; and
(14) 
The City Council may impose additional restrictions to protect adjacent properties from the impact of the specific use.
w. 
No nondepository financial institution may be located within 1,000 feet of another nondepository financial institution; or within 500 feet of the right-of-way of Interstate I-20 or State Highway 180; or within 500 feet of any zoning district which allows residential uses by right.
(1) 
Measurement.
For purposes of this section, measurement shall be made in a straight line, without regard to intervening structures or objects:
A. 
From the nearest portion of the property line of the premises where the existing business is located to the nearest portion of the property line of the premises where the new business is proposed, if confirming separation between businesses;
B. 
From the nearest portion of the right-of-way line of Interstate I-20 or State Highway 180 to the property line of the premises where the new business is proposed if confirming buffering from these roadways; or
C. 
From the nearest portion of any zoning classification which permits residential uses by right to the property line of the premises where the new business is proposed.
x. 
Property in the SF-1AP District shall be permitted to construct a hangar, or an accessory dwelling unit, but not both.
y. 
Hotel, extended stay:
(1) 
Regulations:
A. 
A minimum of 80 guest rooms and/or suites;
B. 
Guest room access from interior hallway;
C. 
Laundry facilities adequate to serve residents at full capacity;
D. 
Minimum of 800 square feet of pool surface area.
z. 
Hotel, full service:
(1) 
Approval: A full-service hotel that meets all the requirements listed in subsection (2) below requires only site plan approval since they are allowed by right in those districts that allow hotels. Any failure to meet one or more of the listed regulations requires an application for a special use permit, which is subject to review and approval by the city council.
(2) 
Regulations:
A. 
A minimum of 80 guest rooms and/or suites;
B. 
A minimum of 4,000 square feet of meeting room space;
C. 
A minimum of one restaurant that provides meals with on-site preparation for a minimum of 30 customers;
D. 
Guest room access from an interior hallway;
E. 
Minimum of 800 square feet of pool surface area;
F. 
Attached covered drive-through area adjacent to hotel lobby or reception area.
aa. 
Hotel, limited service:
(1) 
Regulations:
A. 
A minimum of 700 square feet of meeting room space;
B. 
Limited food and beverage service, but including breakfast buffet service;
C. 
Guest room access from an interior hallway;
D. 
Minimum of 400 square feet of pool surface area; and
E. 
Attached covered drive-through area adjacent to the hotel lobby or reception area.

It is recognized that new types of land use may develop and forms of land use not anticipated herein may seek to locate in the city. In order to provide for such changes and contingencies, a determination as to the appropriate classification of any new or unlisted form of land use shall be made as follows:
13.1 
ADMINISTRATIVE OFFICIAL ACTION
The administrative official shall refer the question concerning any new or unlisted use to the Planning and Zoning Commission requesting an interpretation as to the proper zoning classification into which such use should be placed. The use interpretation question shall be determined as to the nature of the use and whether it involves dwelling activity, sales, processing; type of product, storage and the amount and nature thereof (i.e., enclosed or open storage); anticipated employment; transportation requirements; the general degree of noise, odor, fumes, dust, toxic material and vibration likely to be generated, if any; and the general requirements for public utilities such as water and sanitary sewer.
13.2 
COMMISSION ACTION
The Planning and Zoning Commission shall consider the nature and described performance of the proposed use and its compatibility with the uses permitted in the various zoning districts, and determine the zoning district or districts within which such use should be permitted.
13.3 
COUNCIL ACTION
The Planning and Zoning Commission shall transmit its findings and recommendations to the City Council as to the classification proposed for any new or unlisted use. The City Council shall approve the recommendation of the Planning and Zoning Commission, or make such other determination concerning the classification of such use as appropriate, based upon its findings of fact, and amend this ordinance to reflect said findings and decisions.
