(a)
In this section, “disability” or “disabilities” shall mean a condition as defined by section 681.001 of the Texas Transportation Code, as amended.
(b)
No person who does not have a disability and who is not transporting a person with a disability shall park a motor vehicle on which are displayed either license plates or a disabled parking placard issued by the state department of transportation under section 504.201 or 681.004 of the Texas Transportation Code in a parking space or area designated specifically for persons with disabilities by a person who owns or controls private property used for parking.
(c)
No person shall park a motor vehicle on which are not displayed either license plates or a disabled parking placard issued by the state department of transportation under section 504.201 or 681.004 of the Texas Transportation Code in a parking space or area designated specifically for persons with disabilities by a person who owns or controls private property used for parking.
(d)
This section shall only apply to a parking space or area for persons with disabilities on private property that is designated in compliance with standards and specifications adopted by the commissioner of licensing and regulation under section 5(i), article 9102, Revised Statutes, relating to the identification and dimensions of parking spaces for persons with disabilities. Designation of parking spaces shall be done by a person who owns or controls private property used for parking.
(e)
Any person who violates this section shall be guilty of a misdemeanor and upon conviction shall be punished by a fine of not less than one hundred dollars ($100.00) nor more than two hundred dollars ($200.00). Each occurrence of parking in violation of this section shall constitute a separate offense.
