There is hereby created the position of code enforcement officer for the city. The code enforcement officer shall be designated by and shall work under the direction of the city manager, or at the discretion of the city manager the code enforcement officer will work under the direction of the chief of police. The code enforcement officer shall receive such salary as may be from time to time established.

The code enforcement officer shall possess all qualifications necessary for registration with the department of state health services as provided by state law and shall maintain such registration as a condition of continued employment.

(a) 
The code enforcement officer shall enforce the provisions of the city Code of Ordinances and other ordinances of the city relating to building standards, fire safety, unsafe buildings, junked vehicles, signs, subdivisions and zoning, and in addition shall perform other duties as may from time to time be directed.
(b) 
The code enforcement officer shall be authorized to direct the abatement of any nuisance or other code violation within the scope of the enforcement powers set forth herein, to issue any required notices and to initiate abatement proceedings in conformity with the applicable provisions of this code and state law, and in addition shall be authorized to issue any required citations and initiate proceedings in the municipal court against persons deemed to be in violation of code provisions within the scope of the enforcement powers set forth herein.

The code enforcement officer is hereby authorized, pursuant to Texas Code of Criminal Procedure, article 18.05, to obtain and execute administrative search warrants in connection with any inspection which may be necessary in the performance of the duties set out herein and for which a warrant may be required.
