For the purpose of this article the following definition shall apply unless the context clearly indicates or requires a different meaning:
Garage sale.
(1) 
Includes the terms “porch sale,” “yard sale,” “lawn sale,” “family sale,” “rummage sale,” “white elephant sale,” “flea market sale,” “attic sale,” “patio sale,” “plant sale,” “sample sale,” “estate sale” or any other similar terms, and shall mean the sale of household goods, furniture, equipment, utensils, appliances, tools, personal clothing or effects, novelty items, glassware, farm products, or any similar personal property, by a person or persons in the business of selling such tangible personal property.

Shall not include accumulation of new merchandise or used merchandise acquired solely for the purpose of resale.
Permit.
Written approval by a code enforcement official or staff to allow garage sale.

The number of garage sales a person or household, firm, group, corporation or organization may have shall not exceed four (4) per year, and may not be conducted more frequently than one (1) every three-month period. The duration of a garage sale shall not exceed four (4) consecutive days for any single location or address. Sales will be tracked by address location. A permit application shall be completed and permit fee of $5.00 will be charged prior to issuance of a permit. Garage sale permits may be obtained at the city police department administration office located at 1150 N. Hwy 67, Midlothian Texas.

Garage sales may begin no earlier than 7:00 a.m. and must conclude by 6:00 p.m.

(a) 
Sales may only occur after permit is issued.
(b) 
Permits will only be issued to residents of the city.
(c) 
No garage sale will exceed 4 consecutive days.
(d) 
Bad weather, rainout or substitute dates. Once a permit has been issued it will be handled on a case-by-case basis by the code enforcement officer.
(e) 
Multifamily properties (apartments complexes). In accordance with city ordinances, garage sales are limited to four per year and the management for the complex must apply for the permit.

Any violation of the terms of this article is declared to be a misdemeanor, and any person, firm, group corporation or organization found to be guilty thereof shall be punishable by a fine not to exceed $1,000.00. Each day that such violation continues shall constitute a separate offense and shall be punishable accordingly.
