For the purposes of this article, a truck hereby means any type of commercial motor vehicle having three (3) or more axles, more commonly but not exclusively referred to as a tractor-trailer, semi-truck, or 18-wheeler.

It is hereby declared unlawful for any person to drive, operate or park a truck on or across the streets specified below:
(1) 
Wyatt Road from U.S. Highway 67 to Ward Road;
(2) 
Ward Road from Wyatt Road to Cement Valley Road;
(3) 
North 8th Street from Business 287 (Main Street) to North 9th Street;
(4) 
Clinton/South Clinton Lane from U.S. Highway 287 to F.M. 1387;
(5) 
Daisy Road;
(6) 
Kirk Road;
(7) 
Oak Tree Lane from Mt. Zion Road to Ashford Lane;
(8) 
Creekbend Drive from South Midlothian Parkway to Mt. Zion Road;
(9) 
Midlothian Parkway from E. Main Street to approximately 500 feet north of Mockingbird Lane;
(10) 
Mockingbird Lane from Midlothian Parkway to North Walnut Grove Road;
(11) 
Onward Road from FM 1387 to Tar Road;
(12) 
North Walnut Grove Road from FM 1387 to Mockingbird Lane; and
(13) 
Park Place Boulevard from FM 1387 to Mockingbird Lane.

It is hereby declared unlawful for any person to drive, operate or park a truck having a combined gross weight over 40,000 pounds, except a ready-mix concrete truck as defined under Texas Transportation Code, section 622.011, which may not exceed up to 48,000 pounds, on or across the streets specified below:
(1) 
South Walnut Grove Road from U.S. Highway 287 to FM 1387;
(2) 
Ashford Lane from South 14th Street to FM 663;
(3) 
Plainview Road from US Highway 287 to Ledgestone Lane; and
(4) 
VV Jones Road from Power Way (south) to FM 875.

The city council does hereby authorize its city engineer and the police chief, or either of them, to provide for the placement and direction of signs, signals and traffic-control devices as are reasonably necessary to accomplish the purposes of this article.

The provisions of this article shall not apply to the following vehicles:
(1) 
Emergency vehicles, school buses and commercial motor vehicles serving local businesses and/or properties along North 8th Street;
(2) 
Vehicles traveling to or from a truck terminal, garage, place of repair, place of performing a service, or a place of loading or unloading, over the shortest practicable route to or from a point on a truck route; any such vehicle shall be permitted to proceed from one such point not on a truck route to another such point without returning to a truck route, if to so return would unreasonably increase the distance to be traveled between such points; the operator of any such vehicle shall carry evidence of the location of its last stop and of its immediate destination in order for this exception to apply;
(3) 
Emergency vehicles operating in response to any emergency call;
(4) 
Vehicles operated by a public utility while cruising in an assigned area for the purpose of inspecting the facilities of said public utility and/or providing maintenance service to said facilities; and
(5) 
Vehicles operated for public service, i.e., garbage pickups, street repair and water service and maintenance.

Any person who shall violate any of the provisions of this article shall be guilty of a misdemeanor, and upon conviction thereof in the municipal court, such violation shall be subject to punishment by a fine not to exceed $500.00, and each and every instance of the violation of this article shall constitute a separate offense and shall be punishable by separate punishment for each offense.

In addition to the penalty provided in section 12.04.006 hereof, the police department of the city shall also have the authority and power to order towing of any truck which is parked and found to be in violation of this article, and the owner of such truck shall be responsible to the city for the payment of all towing charges, services and fees prior to the release of any such property to the owner.
