It shall be unlawful for any person, firm, or corporation who is not registered with the city to engage in the installation, construction, maintenance, repair, alteration, or modification of plumbing or plumbing systems, except as provided in section 3.02.201(b) for repairs by the owner to his/her homestead.
It shall be unlawful for any person who is not licensed as a plumber in accordance with the provisions of the law of the state to engage in plumbing work as described above on new construction.
Persons who are not licensed as a plumber in accordance with the provisions of the law of the state may engage in plumbing work as described above, except for plumbing work on new construction.
The registration application shall require the plumbing contractor’s name, address and telephone number, and such other information as the building official may determine appropriate and proper with respect to background, experience, and previous registration of the applicant.
In addition to providing the information set forth in subsection (c)(1), the applicant shall provide his/her date of birth, Social Security number, number of years performing plumbing work, and certificates of insurance or a copy of an insurance policy showing that the applicant maintains a minimum of $50,000.00 in general liability coverage. Registrants shall maintain with the city current copies of proof of insurance coverage required by this subsection.
Unlicensed applicants must pass a criminal background check to become registered. On the application form, applicants shall state whether the applicant has been convicted or placed on probation for a felony offense. Applicants shall also sign a release authorizing the city’s human resources department to conduct a criminal background check. The chief of police shall make the determination regarding whether an applicant who is found to have been convicted or placed on probation for a felony offense may register, taking into account the type of offense committed, the length of time that has passed since the offense was committed, and public safety. The chief’s decision may be appealed to the city administrator by submission of a written appeal to the city secretary within ten days of the chief’s decision.
By registering persons under this section and Ordinance 2010-02, the city does not warrant or make any representations regarding the skill or abilities of the registrant, nor does the city assume any responsibility for the actions or the quality of work done by the registrant. Any disputes arising from the actions of the registrant shall be between the person contracting for the registrant’s services and the registrant.
