Any person or persons violating any of the provisions of this division shall be guilty of a misdemeanor and shall upon conviction thereof be fined in any sum not to exceed two hundred dollars ($200.00).

It shall be unlawful for any person as owner, operator, agent or employee to engage in the actual preparation or handling of any food, food product, drinks or beverages, for human consumption and where any part of the human body or clothing worn by such person, comes in direct contact with such edible product without first obtaining from the city health officer, or his assistant, a health certificate. Such certificate may be issued only to those persons who are free of any contagious or infectious disease, who have no pathological condition which might be a menace to the public health and who have demonstrated a knowledge of good health and sanitation practices.

Each and every person required by this division to obtain a health certificate shall submit to such examinations and laboratory tests as are necessary to determine the individual’s freedom from contagious and infectious disease, and shall take such test or examination as required by the health officer to demonstrate their understanding of acceptable sanitary practices of food, food products and beverages in handling, storage, and service.

For such examinations each individual will pay to any licensed physician or his assistant his customary charge for this examination.

If a person is found to be free of contagious and infectious disease and has the necessary knowledge of sanitary public food handling, he may be issued a health certificate by any licensed physician. Such certificate shall remain in force for a period of one (1) year from date of issuance, unless revoked for sufficient cause. The city health officer, or his assistant, or the city inspectors, may cite the holder of any health certificate to a re-examination at any time such holder of such certificate is known or suspected to be affected with any of the conditions as set out in the preceding section which re-examination shall be without cost to the holder, and shall not extend the time of such certificate beyond the date for which issued.

Proprietors or managers of establishments where food, food products, or beverages are prepared, handled, used, or dispensed will be held responsible for the health certificates of their employees, and will be subject to similar fines as imposes on the actual handlers of such foods or drinks.
