(a)
Created.
There is hereby created a board to be known
as the city historical preservation commission, which board shall
be an official board of the city.
(b)
Membership.
The board shall consist of 12 members appointed
by the mayor.
(c)
Qualifications of members.
Members shall have an interest
in history, art or architecture and who otherwise have the qualifications
required of appointed officials as stated in the ordinances of the
city.
(d)
Terms.
Members shall serve for a term of two years or
until their successors are appointed.
(e)
Chair and vice-chair.
The board shall elect a chair
and vice-chair from among its members.
(f)
Bylaws.
The board shall adopt bylaws and act in accordance
with such bylaws.
(g)
Quorum; voting.
A majority of the members appointed
shall constitute a quorum, regardless of the number of members authorized
for appointment. Issues are decided by a simple majority of the members
present.

(a)
City-owned property.
The board is responsible for decisions
concerning the operation, maintenance, and alteration of places and
areas of historical, cultural, or architectural importance and significance
that are owned by the city and located within the city limits.
(b)
Designated areas and structures.
The board is also responsible
for decisions concerning the appropriateness of construction, reconstruction,
or alteration of places, areas and structures officially designated
by the city council as places or areas of historical, cultural, or
architectural importance and significance. Such decisions shall be
in accordance with governing regulations duly adopted by the city
council.

Decisions of the board are appealable to the city council. Any
appeal must be in writing and submitted to the city administrator’s
office within 10 days after such decision is rendered. If a decision
of the board is not timely appealed in accordance with this section,
the decision is final.
